PHH Mortgage Corporation named in class action lawsuit over force-placed insurance

Phh Mortgage

This is a class action on behalf of all persons who have or had residential mortgage loans serviced by PHH Mortgage Corporation (“PHH”) and, in connection therewith, were required to pay for lender-placed or “force-placed” hazard insurance policies which involved the payment of a kickback in the form of below-market-rate portfolio tracking, expense reimbursement or any other monetary and/or nonmonetary remuneration to PHH.

The complaint challenges PHH’s practice of purchasing force-placed hazard insurance through Assurant, Inc. subsidiaries American Security Insurance Company (“ASIC”), Standard Guaranty Insurance Company (“SGIC”), and/or Voyager Indemnity Insurance Company (“Voyager”) (collectively “Assurant Specialty Property”), pursuant to agreements that return a financial benefit to PHH. Such agreements are unrelated to any contractual or other bona fide interest in protecting the lender’s interest in the loan, and result in unauthorized, unjustified and unfairly inflated costs to the borrower for force-placed hazard insurance in violation of law.

Classes:

a nationwide class consisting of all persons who, within the applicable statute of limitations, have or had a residential mortgage loan or line of credit serviced by PHH, and had hazard insurance force-placed upon the secured property through Assurant, Inc. or an Assurant, Inc. subsidiary (the “Nationwide Class”); or

a California subclass consisting of all persons who, within the applicable statute of limitations, have or had a residential mortgage loan or line of credit serviced by PHH, secured by property located in the State of California and had hazard insurance force-placed upon the secured property through Assurant, Inc. or an Assurant, Inc. subsidiary (the “California Class”); or

an Illinois subclass consisting of all persons who, within the applicable statute of limitations, have or had a residential mortgage loan or line of credit serviced by PHH, secured by property located in the State of Illinois and had hazard insurance force-placed upon the secured property through Assurant, Inc. or an Assurant, Inc. subsidiary (the “Illinois Class”).

My fiance has a mortgage through PHH and the insurance is through assurant. Due to divorce he fell behind on payments and for almost a year has been going back and forth with PHH trying to do a loan modification and they keep giving us the run around. We are at the end of our rope with them and see there are numerous lawsuits in regards to the tactics of PHH and wonder if there is any help out there for us.

How can I be placed on this Class Action against PHH mortgage. I lost my home in MS due to employment loss. It was a VA Loan and I have recently been told that I shouldn't have been paying PMI on the loan. I was forced into bankruptcy due to my loss of income. I attempted to work with PHH on my home loan only to meet with negative results or no response from them at all.

My husband and I have sent in the amount that Bank of America ask from us and they say it's the wrong amount. They sold are house right from under us when they had the money we sent them. They ask for $5000 to reinstate and in they time that they had are money they are saying know its $7000 that they want. For anyone that has BOA please chime in and let use know if you are having the same trouble.

I have gone through the same, it seems, as everyone else. Sent them the required documentation, then it would get letters stating that they were still missing the documentation...that I had just sent to them. I sent them payments, they would be returned to me, but not before I owed a couple more because they didn't notify me within 30 days that the payments weren't accepted/processed. Before I knew it, they were threatening foreclosure. They would say apply for a modification, then turn me down. They also changed my mortgage from 30 years at initial signing to 20 years without notifying me. Now 30 months behind in payments without notification, the mortgage company came in and gutted the partially finished basement leaving a mess...once again without notifying me and no papers were signed or received by me. Now, they are saying to apply for a modification. If qualified then I might be able to keep my home. I have gotten the run around from this company since purchasing the home in 2006. Nobody at that company has a clue what the other person next to them is doing and how it is affecting our lives. The solution is to find another financial institution to take a loan out with - not this company. But wait, you won't be able to because the mortgage, by this time, as destroyed your credit standing and nobody will help because PHH has screwed you around.

I have had 3 forced attempts at foreclosure. 2 times taxes not beingpaid and several documents withthesame name and different signatures notarized from that same name. They are now attempting again. I have very good notes an have saved every email. I need help.

Hi,
We had the exact problem with our loan with PPH Morgage. We went round and round about the process to set of payments. We have all documentation of communications and agreements. We went thru two modifications with them and they got to the last payment each time and ended it because of some bogus rating and they could never tell us why they,did that. The lied, didn't answer phone calls, refused to work with us. The screamed at us on the phone and talked to us like dogs. Some go named David threatened he would have our house they got it after the Govenor stopped it twice and the went back on the deal to work with us. The kept us in state of forclosure with threats for 3-4 years. They are the worst people we have ever encountered. Everthing mention in this class action suit was done to us.

They are absolutely the worst company in the world to try to work with! As mentioned in anothers response, they treat customers like dogs!!! They talk down to you, as they mention all the initials next to their names. They lie to you everytime you have a question or need information from them. I've personally had several of their rep.'s yell at me and call me a liar! I've dealt with them for over 15 years and really don't know how much more I can take!

Our insurance went up $50.00 a month when PHH Mtg. took over our account. They charged a late fee although we were not late. The problem was they processed our payment as a payment to the principal rather than a payment. You are on hold forever all for something that this their fault and their error.

I was approved for a HAFA Short sale with PHH. Long story but in the end, PHH committed FRAUD on sale documents and misrepresented another bank which owned 20%. 4 years later, I am now being sued for remainder balance. Please help -

We have been jerked around by this company for 8 years now trying to get a loan modification. They don't send paperwork, don't process paperwork, say they don't have payments when they do, add excessive fees and send paperwork then say they changed their mind and demand more and more money. I have been yelled at, laughed at etc on the phone from their representatives. One even told me I could stop sending paperwork because I had killed enough trees. We have been lied to, lied about, foreclosed on twice without ANY notice. We receive taunting, cruel calls from reps. We are lied to on the phone and then receive paperwork that says something totally different than the phone calls. We are a senior couple and the stress from this nightmare has caused us to have major health problems. Their actions during this process have wrecked our credit for the first time in our lives and can't move to another company. They have also added $85,000 worth of fees so now we owe more than our house is even worth. Our statement says they are only putting $250 a month toward our principal out of a $2000 payment each month. They feel they are above the law and must be stopped immediately!!!

i have the same issue got behind due to health problems and keybank sold me to phh mortgage. they were charging excessive fees placed lender insurance on the home at a really high rate had people supposedly doing inspections at 50 a month i would never see any of these people. so finally i worked out to save my home well the house is worth 80,000 and i owe 125,000 and only 200 of my 900 a month is placed on principal more is placed on interest at this rate it will take me 50 years to pay off my house. im so upset they made my loan modification so difficult asked for paperwork ten times and was told was sent it wasnt so they could make me get further behind. finally i was transferred back to keybank but still owe this large amount and keybank tells me to talk to phh while they say its all on keybank so they wont even explain charges. i know they purposely sold me back to keybank knowing they screwed me and wont even deal with me anymore ive made plenty complaints online and on phone to get nowhere. please someone help.

I was refered to that PHH bank and was trying to get a loan. they preapproved me for 120k and then, suspended the loan (116K) because the appraisal was comin in at 95K in downtown Atlanat , were the value is around 186K.Now they PHH is trying to collect fees. I called them and informed them that they havent really done a service and never gave me a package from the beginning and that they were constantly delaying the transaction when my real estate agent and myself called them to collect info on the transaction

Phh reported my credit that my house was in foreclosure which is untrue the loan is current for the pass 3 years everytime I called they ask you to send paperwork on my credit report that they will refused to update my credit I have called a million times no answer am having issues getting a new loan. Same Issue with attempting everything to save my home and the Trail Loan Modification run around! Do not even know where to begin or what kind of attorney to contact. I was approved for 4 Trail Loan Modifications with them and each time I sent the payment it was rejected. I was told to move forward selling the home, they even spoke to Real Estate Agent and closing Attorney and told them to proceed with accepting the contract. Only to find out they filed for foreclosure and I was not able to get clear title. Spent money on survey, appraisal and inspection, down to the wire on closing and buyer had to walk away!

My mortgage has been with PHH mortgage since Bank Atlantic sold it to them. I refinanced under a Harp loan three years ago. I invested several thousands of dollars in the hopes that I could save at least a hundred dollars a month. Over the three years I have not saved any money. I have a closet full of paperwork that includes 15 or 20 "Good Faith " estimates which they sent me almost every week for 6 months. It took them that long to close the refinance. The escrows always have a shortage but the bills stay the same. This year it was short 700.00. I asked them to research my refinance last month still no answer. If there is a class action lawsuit pending I am interested to be included. Mortgage is the biggest investment of anyone's adult life. I can not afford to pay them one cent more than what is accurate. All the numbers are wrong . I am overpaying.

This company stole our house from us. We fought for nearly ten years and finally lost the battle in 2014. Over the years we could get no one to help us. We were told by them if we surrendered our home to them ( Deed In Lieu ) that they would not proceed with a foreclosure and that we could buy again in as little as 2 years (apparently another lie) We were never informed of this lawsuit and just came across it while researching for help and what to do. A lot went on between us in this 9 year time frame and I believe that we could offer valuable information to this case and possibly get some help in return.

My family was also victims with a mortgage that was sold to PHH. We lost our home due to foreclosure. They always told me it wouldn't happen. I had serious medical problems that caused me to be off of work several months, I then lost my job while under a doctor's care. I talked with them so m any times to try to get help due to hardship. I asked to apply for a loan modification. They would say i am mailing it today. I would call them back and they kept telling me they didn't receive it. apps foloan modification. They would tell me they didn't get it. Then after making payments with PMI, they said we could try loan modification and it would be for 40 years. Our initial loan was for 30 years. Now after almost 10 years they want us to pay 40 years. I had been calling in my payments after I lost my job and they always charged me a fee for making payments over the phone with an associate. I sent the packet back and asked for clarification and an explanation of why for 40 years. They got there money anyway we paid pmi insurance for the life of our loan. Every time I called I was given different information. After starting making the loan modification payments. I was told to not make payments or I wouldn't qualify for any help . They mailed payments back to me. I went through this for months. I got letters from a lawyer out of state telling me to contact them regarding foreclosure. I called them and they told me I would havve to call PHH. I called PHH and was told let me send you a packet for a loan modification. I cried so many days trying to deal with them. I called them and begged them to help me annd explained the conversations I had with case manager. They said I am sorry she doesn't work here anymore. Yet her voicemna still worked and I had made numerous calls to her and left her messages to return her calls. It was a complete nightmare. They even told me to send in a new app for loan modification after they gave me the auction date my house was to be sold. They sold it back to Fannie Mae before the auction date. Is there any help out there for my family. We moved into that house when my son was six yrs old. My family has been devastated. It has been the worst nightmare. We are still suffering from it. Please help us.

I am looking for an action suit against this co. For the last 3 years rhey have told me I am not finishes with my loan till 2018. I have paid extra every month. Taxes have not gone up....I finally found the original loan. 15 years 8/2002. I have been going through hell with this company for 3 years. I was 6 payments behind and asked for assistance because I was laid off but had a new job. They told me to fill out the paper work and get it processed and they would have a program for me. I did this and waited 2 more months and was told I had to get out of my house for failure to pay. When I asked why they said they did not have any program that would fit me. I then became homeless and not knowing what to do I moved 2000 miles to live with family. I was made to leave everything because I was given 3 days to get out. They told me I would come home from work and not be able to get in my house. after the move they then told me I could sell my property by doing a short sale. I found a buyer and a realitor. I contacted Pph and they said it was to late, forclosure has already started. So now 3 years later I am still getting program offers that will never happen and associates at this company who have no idea what is going on. I was also told that there was a lien on the property from the previous owner that was never cleared before I bought the house.
How can this happen????

I applied for a modification with Phh because I was on disability at my job do to an injury. For 7 months I would only be allow a portion of my pay . Ever since then it has literally been a nightmare! Once I went back to work I tried to rewrite my mortgage with another company unimpressed by the way Phh handled things. Only to have my banker contact me informing me that I was currently 16,000.00 behind on my. Mortgage and needed to contact them. Never missing 1 payment It didn't take long for me to realize that the right hand, had no idea what the left hand was doing, considering I had just received a check for an over and congrats on not missing a payment. Two weeks later I got a letter stating intent to for close with my check for that months payment returned in an envelope. I got a lawyer who contacted their lawyer which took three months to get a response but only after threatening to sue. This went on for just about 3 years. My credit being cursed with a foreclosure taking me rock bottom. I settled and stayed with the company at a new interest rate lower of course so that I could focus on my credit, not being able to take the hit for another, who knows how many years for a lawsuit. I paid Phh for exactly 1 year on time no doubt at the new lower interest rate with every intention to find a new mortgage company. In January of 2016 I called Phh for tax information that I never received. Two weeks later I got a letter with intent to for close. I then contacted the BBB who had the president liaison work with me personally but raising my mortgage 300.00 because of calculations that were not done properly the first time. 3 months later my mortgage was raised. Another 115.00 for the same reason. Not being able to get picked up by anyone else do to my low credit score, once again I had to re modify with them. This year I have returned to foreclosure status because I sent extra money to put me ahead on payments. In which now, they are saying that I did not make payments last year so the money went to that. They sent back my July payment, and said that I am 5,000 in the whole this year, an in full forclosue. That the modification that I applied for last year was denied because they did not have all of the paperwork. And that the liaison from the presidents office that I dealt with last year doesn't exist?

was force to get Assurant ins then house burn and they did not have enough insurance coverage and built a frame home with roof but nothing inside. we are living in the pool house and now they sold our mortgage to loanliner but no one to talk about equity or refinance. been living here since 1999 5200sq ft with pool house 1000 sqft 6acres
