This case concerns cross-linked polyethylene plumbing tubes (“PEX Tubing”), the brass fittings required to connect the PEX Tubing together (“PEX Fittings”), and the stainless steel clamps (herein “PEX Clamps”) required for joining the PEX Tubing and PEX Fittings. As discussed below, the PEX Tubing, the PEX Fittings and the PEX Clamps at issue are all manufactured or distributed by Defendant NIBCO, Inc. (“NIBCO” or “Defendant”) and suffer from undisclosed design and/or manufacturing defects that inevitably cause them to fail prematurely Specifically, the PEX Tubing suffers from a design and/or manufacturing defect because it is prone to premature oxidative failure and creep rupture.

As alleged in the complaint, the PEX Fittings suffer from a design and/or manufacturing defect because they are prone to dezincification corrosion. The PEX Clamps suffer from a design and/or manufacturing defect because they are prone to failure by chloride-induced stress corrosion cracking. When any of these components fail, it leads to the release of water which causes significant damage to surrounding property and/or prevents the plumbing system from functioning as intended.

NIBCO has manufactured and advertised its PEX Products for use in plumbing systems throughout the United States. It has repeatedly represented that consumers should trust NIBCO to provide the highest quality PEX Products because the company has over 100 years of industry experience and is an industry leader in the manufacture of PEX Products. NIBCO warranted that its PEX tubing would be free from any defects in materials and workmanship for a period ranging from ten (10) years to twenty-five (25) years, dependent upon whether NIBCO PEX fittings and NIBCO valves and installation accessories were also used in the installation.

The complaint contends that contrary to these affirmative statements, the PEX Products suffer from design and/or manufacturing defects. Specifically, and as a result of such defects, the PEX Tubing is predisposed to premature oxidative failure and creep rupture, the PEX Fittings are predisposed to prematurely fail as a result of dezincification corrosion, and the PEX Clamps are predisposed to prematurely fail as a result of chloride-induced stress corrosion cracking.

The PEX Product Defects have caused plumbing systems to catastrophically fail and release water, which has caused and will continue to cause Plaintiffs and the Class to incur damages through no fault of their own.

Plaintiffs seek relief for damages sustained by Plaintiffs and the Class that were proximately caused by NIBCO’s Defective PEX Products used in Plaintiffs’ and Class members’ homes and other structures, or which otherwise were installed in the homes and structures of Plaintiffs and the Class.

Class: All persons or entities who sustained damages proximately caused by NIBCO’s Defective PEX Products used in the water plumbing systems of Plaintiffs’ and Class members’ homes and other structures, or which otherwise were installed in the homes and structures of Plaintiffs and the Class and require remediation.

Our home was built in 2008. 2 weeks ago, I walked into the laundry room to find it raining from my ceiling. The pipe itself failed. When the plumber showed up at my house, he said that he had fixed the same problem for my neighbor two houses down from me two years ago. Also, my neighbor across the street had a pipe burst a week before mine. Then, her neighbor on the other side said they had the same problem. If you were counting, that is four houses on a block of 5-year-old house. I'm just thanking God that the company who installed my water-softener also installed a shut-off for all water coming into the house. At least I can shut it off when I go out of town, still run the sprinklers, and not worry about coming home to a flood. Something has to be done about this!

Yes we have the same issue pipes installed in 2006, another leak today nibco durapex. Master Tech plumbing in Columbia Missouri originally installed all our pipes in 2006 to replace all the plumbing in our home (so imagine the cost when all plumbing is expensive). All pinhole sized leaks lengthwise in the hot water tubing. Now I am worried of the toll it's had on our hot water heater which was also replaced directly before the pipes were.

I installed PEX in an addition to my house in 2008. I have had about 6 leaks in about an 8 month period. Contacted PEX through supplier and they had an "engineer" come to house to investigate and his claim was that the leaks were due to thermal expansion not manufacturing defects, so they denied my claim. It would burst maybe 2 times a year now its more like 6-10 . we have sent pieces of the defective pipe to nibco and they say it is not a manufacturing fault. I have had numerous ruptures in my pipe over the last three years. The cracks in the pipe run parallel with the pipe itself. It only seems to be affected in the hot water side or close to the hot water. I recently had a complete re-pipe due to a rupture in the slab (monolithic). Cost me $5800.00 due to opening up walls and having to run everything through the attic. I would like to participate in whatever action can be taken!

Three story home build for owner in 2000. 10/23/2014 we discovered a leak in the DuraPex line leading into our hot water heater. The leak saturated the hot water heater resulting in damage to the electrical components which necessitated replacing the water heater. That evening we discovered a major leak in a workout room which caused ceiling, wall and carpet damage.
This too was caused by 3 leaks in the DuraPex tubing running across the ceiling. We are still in the process of repairing all damage.

The plumbing company which installed the PEX system showed up and immediately replaced the clamps with a new type of clamp made of different metal. We bought our home in Clover, SC in 2008. In 2014 we started to experience water leaks. The first one was a hose from our water heater which split. The plumber came and fixed that issue, but he warned my husband that to be careful that the next thing that would leak may be in our walls, and sure enough about 3 months later we got our first leak. It was leaking down into my living room. They came, tore up the wall in my laundry room and the ceiling in the living room. One month later the pipe started leaking again in the living room, in the same spot that it had done prior. This is very frustrating as we have a hole in our ceiling and our walls upstairs. We were just about to fix the ceiling when the new leak started 2 days ago. Thank god we have a homeowners warranty company, but this whole thing is really starting to get costly. Not only do we pay the service fee of $50 each time, we have to pay to repair the ceiling and walls. Thank god we were home everytime this has happened otherwise who knows how much damage there would have been. They need to really help those of us who have this issue.....we didn't know when we bought our homes they used crappy pipes!! Now we have to figure out how to get all of this fixed, and we have a 3 story house....and I know it's going to be expensive!!

Just fixed the second leak in the Dura PEX tubing used for the hot water line in my home. The first leak was 5 months ago. I now feel uncomfortable closing up the sheetrock, for fear that another section of the pipe will start leaking. This is unacceptable, and obviously faulty pipe.

Home was built in 2001, we bought it in 2009 and was not told of water leak problem. We are averaging a CPI DURA-PEX Tubing leak every four months, mostly on the hot water tubing.
We have hard wood floor damage, dry wall and insulation damage, and the expense of having a nice local plumber come during the day, evening, night and weekends to fix our leaks. After the leak two weeks ago he is recommending a total replacement of all the tubing. I'm not the only one in the area going through this.

Just had a piece of pex split apart within a foot of the water heater, major water damage in a warehouse storage room. I'm in the process of a warranty claim with manufacture, will see where that goes, the pipe blew out like a blue balloon, the sad thing is the entire warehouse has this product in it, now hard to sleep at night.

In 2005, I had my home built in York, SC (Lake Wylie area) by Westport Homes, I have had 6 leaks within the past year, due to our plumbing be done with dura pex pipe. Each leak has been terrible, lots of damage. The latest leak sprang in the master bathroom ceiling about 12 feet from hot water heater, the bathroom is in process of being repaired and to my disbelief I discovered the garage floor all wet today, another leak sprang adjacent to bathtub, inside wall. I gave turned only one claim into my homeowners ins. As I know they don't like a lot of claims, they will cancel policy. The combined damages are in the thousands. To replace all pipes in house would be highly expensive, I am not prepared for this expense. Please help.

Consolidated Pipe / NIBCO / (Chub Ins) got together to jerk folks out of their money with pex fittings. My first experience was a 1" main line failure (4 years after install). Since then... multiple failures. Try explaining to a 9 year old why their toys were all destroyed.

I tried asking NIBCO to help. They sent me to Chub rep who said tough luck... Today... same president running the same operation in Knoxville. How can these jerks get away with this for so long?

It took me 3 days of contacting Mitchell Co. to find out what was happening and what about the 10 year home warranty! After spending $85 to stop the leak and be left with water damage in my walls and some of the floor as well as a nice 12 inch hole in my wall from the plumber, I am at a loss! I'm a builder. I built my new home in 2010. My first ownership of a house with Pex. In 5 years now we've had 6 failures with flooding. One costing about $35,000. All due to clamp failures. At least 2 other pin-hole leaks floods. This is in Oklahoma. I understand from the builders side and now the homeowners side. Unfortunately it is the products fault. And that falls back to the manufacturer. We need reparations for their lack of LONG term and complete testing. I want to join in a lawsuit! At the same time, I want the people who have losses due to these plumbing issues to be the ones who receive the MAJORITY of any settlement monies!!!!!!!

I am the original owner of a new home built in Elberta, AL in 2002. We had our first CPI Durapex leak (a big one) in 2008. As of this weekend, we have had 11 leaks, mostly pinhole leaks on the hot side, and they are occurring more frequently and further away from the water heater. Replumbing is the only solution and a former plumber recommended REHAU PEXa for what it's worth. All our leaks are in the tubing and have nothing to do with the clamps or connections. I've saved all the tube that was cut out in recent leaks but did not save the first two as I thought it was just bad luck. Unless you hear about this problem from a neighbor or plumber, it takes about 3 leaks before you realize all the pipes in your house are defective.

I have Nibco plumbing in my 4yr old house built by Meritage Homes in San Antonio, Texas. I have had 2 plumbing leaks in the last 12 mos. Meritage is no help as they say my plumbing warranty expires after 2yrs. I have had to file insurance claims and pay a large deductible. My insurance company tried to subrogate against Nibco but Nibco declined. Plumber says it is a matter of time before other leaks appear.

Since mid of last year, we have had water leakage originally from the hot water area, then from the ceilings in the living room, garage, bathroom, kitchen areas. We hired a handyman to repair the 3 times with the burst water pipes. Since the issue had occurred multiple times, we just had the plumbers to (1). cut out the "bad red pipe", add flexible stainless steel water heater connector, (2). take out ted nibco pex pipes, reinstall cpvc flowgaurd gold water pipes, (3). repair sheet rock and paint. My house was built in 2006, in middle Tennessee. I have had a total of six pin hole leaks in my pex. Four leaks were adjacent to the hot water heater, the fifth was in bathroom wall and currently a leak under my slab. We have shut off valve installed directly in the hot water line. New home built in 2007. This year 2015 I just experienced one stainless steel clamp ruptured and Behold, hot water everywhere. I heard a rushing sound as if one was taking a shower. Not so, it was pex clamp rupture off a 90 connecting two pipes. So there we are standing in a pond of water over our carpet. The water ran through three bedrooms and down the hall. The hell began in the early morning hours bout 1am. So water gushed out for no telling how long. We are still trying to recover from the water damage. Hope to sell this home soon. Found out the whole house had these pex clamps... Any suggestions on how to get in with the class action I would love to find out. Thanks

I have been in my house in Alabama which was built in 2006 for a little over a year. Just had my first pin hole leak above my master bath room which damaged my ceiling. Was informed by the plumber of this ongoing problem with Dura Pex tubing. He recommends installing an expansion tank on the hot water heater. He said it may postpone the problem for awhile but most likely I will have to replace all of the Dura Pex. Apparently my house has a mixed bag of tubing or some of it has already been replaced. I would be interested joining in a class action to cover costs of all of this.

The builder who also ownes a plumbing co told me the house was built with dura pex. I had my home re-plumbed about 6 years ago due to under slab leaks. The plumbers ran all the pipes over-head to get away from the expense of breaking through the slab to fix the leaks. Since then we have had to repair over 10 leaks in the attic, with the last two this past week. These last two caused extensive damage... ceiling collapse in one room and leak in bedroom that caused television to be ruined. As all of the other responders on this site, I need advice and help as to what I need to do to remedy this problem.

I live in Foley, AL and my home was built in 2004 by Gooden Homes of Pensacola, FL. This is a subdivision with 70 homes. The plumber I called told me of another homeowner just a few lots away who has had the same problem several times and he recently had to replace all piping. However, she had a different builder (Benchmark) and bought it 5-1/2 years ago from the owner. We built our home in 2004 and I just had to have my THIRD water leak repaired in my hot water pex line coming from my tankless water heater. First leak occurred in 2012 and was repaired by plumber with only minor damage to garage wall from the leak and the second and third leak happened in the month of October 2015 this year and has caused over $12,000 in damages to my kitchen wall and floor. I have had to file a claim with our insurance company. My entire house is plumbed with this Red colored Pex tubing our plumber said was made by NIBCO and it is going to be very expensive to have my entire home redone and we cannot afford to do that. Replacing this plumbing line is not covered under our home owners policy. I would like to talk to someone about how we can join this class action law suit and see what else we need to do about being compensated for the cost to have all this plumbing replaced!

Same issues as almost everyone else! Dura-Pex pipes. Just had our 5th pin size leak in hot water pipe. Each time it's been getting worse. Now the entire closet flooring has to be replaced as well as the subflooring and baseboards. Oh! And the tile in the shower. this is aside from the typical Sheetrock repair. We can't afford to re plumb the entire house not can we continue to afford the repairs to our home because of defective materials. I worry about leaks we don't know about- I worry about mold or mildew. Of course the absolute mess it creates is awful and just not acceptable. Please include us in whatever suit you have. I contacted NIBCO and sent them the sections of leaking pipe for analysis. Here I am again, a week later, and have another pipe that has cracked!!! This time will probably be major repairs as the ceilings in the kitchen are wet, as well as the garage ceilings. This is getting rediculous!!! I have spoken to NIBCO, and the guy told me he would check with the engineer who is "checking the pipe" (since 2014?). I want to be in with a Class Action Lawsuit against this corrupt company with it's DEFECTIVE products!! I can't get any response in email from anyone about this?? Our home was built in 2011 and we've had 8 issues with our plumbing since then to include unseen leaks that wherelater discovered when on Thanksgiving 2015 the ceiling in my daughters bedroom had caved in and a slow misting leak was discovered coming from a blue pex pipe which obviously soaked the insulation and sheetrock over time. Recently in May of 2016, we found a heavy leak coming from out ceiling wall the divides our kitchen and dinning room. After calling out another emergency plumber, it was discovered the a red pex pipe was leaking in the same manner as the leak discovered in the ceiling over our daughters bedroom. This latest leak had caused damage within the walls, floorboard damage and soaked the entire carpet in our dinning room. Turns out the pex tubes used are designed by NIBCO. After many emails & many complaints and advisements of legal action, our builder is working with us on the problem. However, we have also looked into the class action lawsuit against NIBCO.

In Houston leave home for three weeks and you have a home totaled from mold. In the 80's a friend home flooded and they were displaced for four months and well over 100,000 in home and personal property damage.

Last year during day stepped in my office with shared wall with washroom and water heater located directly above that wall and soaked floor. We have just bought the house, which was built in 2008, and we have pipe bursts two times in a span of two months.
The first repair was done by re-piping, and now we are going through the second issue, not sure what kind of fix will be applied and how much property has been damaged/damaging. Just now the plumbing company notified us that the product used in piping is NIBCO DURAPEX.
We have been going through extremely painful period, mental stress, agoniy and inconvenience, on top of that this issue has been causing so much damage to the property which will be very expensive to repair and make it like the previous state before pipe bursts.
I demand compensation from the manufacturer, and fix the issues and make the home as like the original state ASAP. Please add me in the lawsuit.

"DH Horton built my home in 2012 in the Holland Lakes Subdivision. DR Horton used a subcontractor Dupree Plumbing which used PEX piping manufactured by NIBCO. Two weeks ago, pipes started linking inside the sheet rock where the pipe comes out of the concrete slab into the interior wall of utility room. The linking water has damage the installation and wall and possible other parts of the house. A plumber capped off hot water line where it was leaking in attempt to repair it; however, it is still leaking. I do not have hot water throughout the house. A lawsuit has been filed against the manufacturing of the pipe. The lawsuit alleges that NIBCO PEX tubing is prone to oxidization. Oxidization is the process, whereby oxygen affects the quality of a material, such as metal or plastic. Oxidization of PEX tubing leads to cracks and ruptures."

Unfortunately, we have been dealing with this issue (NIBCO pipes leaking) since 2013 and have plumbers at our house as I type this, fixing one of five or six different issues we've had since 2013. We tried (on another page, I believe) to get involved with the current class action lawsuit but haven't heard from an attorney--only a generic note from the site--which tells us that either it's settled, there's no longer a leading bailiff, or various other things. Either way, we don't plan to simply let this go and never get any reimbursement from all we've poured into fixing these issues. Further, with those crappy pipes all over our house, we will see more and more of these problems until they are replaced. *sigh*

Sadly, this isn't something insurance can cover, so it's purely a matter of waiting for NIBCO to respond. They requested photos proving that we have their product in our house, so I sent them nine photos.

I just experienced my 8th water leak today due to faulty CPI dura pex tubing. Everyone of my leaks have been the tubing with either pin hole leaks or as in my worst issue the tubing split the length of the tube approx 3" and caused my sons bedroom carpet to become fully saturated and my garage was sitting in 4" of hot water. I filed a claim with Zurn pex about the f1807 fittings and I have been waiting for a whole year for them to view my claim.
