The lawsuit was brought  on behalf of a class of homeowners across the nation (the “Class”) to challenge Defendant Nationstar Mortgage, LLC’s (“Defendant” or “Nationstar”) intentional and systematic failure to provide permanent loan modifications to borrowers who signed Permanent Modification Agreements (“PMAs”) under the Home Affordable Modification Program (“HAMP”).

As alleged, Nationstar has serially failed to honor its express and implied contractual obligations under its PMAs, has made repeated misrepresentations of material fact, and has engaged in business practices that are deceptive, immoral, unscrupulous, unfair, and oppressive under California law.

Under the Troubled Asset Relief Program (“TARP”), also known as the taxpayer bailout, the United States Government provided the nation’s largest financial institutions with nearly $700 billion in funds to address what was widely accepted as an unprecedented financial crisis.

A key feature of TARP is the Making Home Affordable Program, of which the HAMP is a major component. Under the HAMP, servicers like Nationstar and other major lenders receive incentive payments for providing mortgage loan modifications to eligible borrowers such as Plaintiff Burton and the putative Class.

In or around May 2009, Nationstar signed a contract with the U.S. Department of the Treasury, through its agent, Fannie Mae, agreeing to participate in the HAMP as an approved HAMP servicer. Nationstar thereafter executed an amended Servicer Participation Agreement (“SPA”) in or around September 2010.

As a HAMP servicer, Nationstar entered into written PMAs for modifications with Plaintiff and other eligible Nationstar borrowers. These PMAs, which were form contracts, expressly required Nationstar to permanently modify the borrower’s loan pursuant to the terms of the PMA.

Plaintiff and the members of the putative Class complied with their obligations under their TPP Agreements and PMAs by executing and submitting all required documentation, answering all questions truthfully, keeping their representations true and accurate, and making their required trial period payments. Despite Plaintiff’s and the other Class Members’ full performance,

According to the complaint, Nationstar has ignored its obligations under their PMAs and the HAMP by refusing to permanently modify their loans. Nationstar’s failure to permanently modify its borrowers’ loans is no accident. To the contrary, Nationstar has knowingly established a system designed to wrongfully deprive its eligible HAMP borrowers of an opportunity to modify their mortgages, pay their loans, and save their houses from foreclosure. Nationstar’s actions, which serve only its interest in extracting as much money as possible from borrowers it deems are at risk of default, thwart the very purpose of HAMP, constitute express and implied breaches of its various contracts, and amount to immoral, unlawful, and unfair business practices under California’s Consumer Legal Remedies Act.

I have been struggling with the same problem for the past 6 months. It is impossible to speak with anyone, and no e-mail addresses or last names are provided. My home expense to gross income ratio is over 33%, yet they have denied me for a HAMP modification. In addition, they repeatedly "lose" faxed information and become very angry when asked if the documents can be mailed "certified, return receipt". I would love to become part of any additional class actions.

This company is out to commit fraud. It seems that Nationstar is forcing customers to use their website instead of receiving documents through the U.S. mail, in order to facilitate fraud and make it more difficult for the consumer to prove. Don't consent to web access! It's better to force them to commit mail fraud when they send you documents. This, by the way, is why they are so reluctant to mail anything. Set up a mail drop through the post office using a third party company that tracks all incoming mail. Communicate with them only by certified letter.

I have been trying to get a loan modification from Nationstar for 3 years. I even have an email from one person working on the loan saying I am sure they will approve this loan modification and then they denied me. I am going to a mediation this Thurs and they have a trial set for this coming Monday, May 13 I feel I have always qualified but they kept denying . I even had the top woman from HAMP working on it and we were denied. She was surprised.

Nation Star said that they were giving me a modification three or four different times, never permanent. The last was an interest only modification so I could catch up but I never did. Nothing was being applied to the principal and instead of my mortgage amount going down, it has gone up. It is now $2,000+ than what I paid for it about eight years ago. I have been going through this about 2-4 yrs with them to now say that they are foreclosing on my home. They have added all these unexplained fees. We appeared in court and the judge asked the representative to have Nationstar give me an explaination. They have yet to do that in writing. We had a April 2013 court date in which they postponed and didn't even notify me not to come. I was there to be told that they rescheduled. They still have not given me what was asked for in writing, instead they sent me a payment history and it has all the extra corporate fees they call it on there. The whole time that they had suppose to have had me under this modification my mortgage amount was still adding up for them to tell me that I owe $10,000+ and my house was being foreclosed on. I work four hours away from my home. I work and come home on the weekends. I rented a place not to far from where I worked but could no longer afford to stay there because now I had to get money and try to borrow money from friends to keep my home. I was forced to stay in a place that I was co-owner of that didn't have any windows, no plumbing, ext. because I had no more money. Everything is behind including my car note and I am on the tip of loosing that. The finance company had taken it before and I got the money from family members to get it back. I've been trying to say every penny and not paying other bills so that I can have the money on May 30, 2013 so that Nation Star will not foreclose on my house. I can fix up the place that I'm in because I need the money to give Nation Star which is my refund from my taxes and borrowed money from friends and family.

I have a 5yr old grandson that I also keep to help my son and we are sleeping in a house with boards on the windows and no plumbing. My son is staying with a friend. My son just starting working again because he had major surgery two to three yrs ago and wasn't able to really work. My family was split up due to this hardship. I need my home so I don't have a choice right now. I retire in 2yrs and 2mos and will be there permanently, so I have to save my home.

My house has equity and is not upside down. I've done a lot of work to my house since I bought it. Nationstar has to be stopped. It is not right for them to take people homes and say that they are giving you a modification and they aren't really. They are just prolonging the time to get to an amount that they think you can't pay.

I went to a mediation and they showed up with none of my papers. They asked for my most recent April statement. This is ridiculous!! They should have asked for it before the mediation. All they want to do is have me agree to a 120 day extension for a sale date. I am going back to Court to try and get a continuance and tell the a judge about my 20 min mediation. We all have to get together and do something about this. We need a lawyer!

I was asked to send in the same documents. even though they hadt them, they made me send them over and over and over again. at the very end two weeks before my foreclosure date I was in review because they said oh I'm sorry to checkstubs you were sending it from December to now we're not correct. They had the corrected checkstubs by April 25th but i was still foreclosed on May 7th this company is a horrible company they're not going to make it affordable make me what so ever so I am very interested in finding out about this class action lawsuit that hopefully going on because I want to meet with my realtor and I did everything today at the studio we jump through hoops week by week email they did everything in your power they had this much somewhere be a very happy indeed indeed move I had to do something and they did absolutely nothing over and over again

I went to Court with a lawyer to try and get a continuance and the horrible judge here in Miami would not continue it .WhenI tried to speak up about my 20 min mediation she would not listen. It was either go to trial that afternoon and face a 30 day sale date or agree to a 120 day sale. I was told I could extend that another 90 days. I could just cry, my beautiful apt that I worked so hard for . All this over a loan modification and i have equity inthe apt. there is an agency that we should all complain to. consumer Financial Protection Bureau 855 411 2372 or www. Consumerfinance.gov/complaint. Nationstar stipulated with the govt to help consumers. We all have to ban together and teach them a lesson. Is there not a lawyer out there to start a class action suit. The one I spoke to Mr Woodrow only takes cases where they gve the mod and then cancelled it. I will become an activist on this ! Please let's try and find help!

Hi Everyone, I just spoke to Hector at the Consumer Financial Protection Bureau. 855 411 2372 . He told me to go to consumerfinance.gov to submit a complaint . You can then fax any documents to 855 237 2392 . I felt like they are willing to help!! If we all do this we can get even with Nationstar.

At the time me and my now ex husband owned our home, we had Nationstar and they were always constantly willing to help... or at least that what they said! Then they really got sloppy with we can modify your loan if you send this much... no we missed that dead line now you need to send more. They constantly left us with NO way to work on saving our home and it was foreclosed on. I would love to know if we fall in the guidelines of this lawsuit because of the years of stress resulting in loosing our home. I truly hate that company and would love to take them down and not let anyone else go through what we did. Shame on that company!!!

We were current on our loan which was sold from First Horizon to Nationstar. They said we had to be behind 3 months before we could apply for the program, my husbands salary was cut and we were trying to be proactive while I was in the process of getting disablity. I sent in paperwork to them start in 2010 and they continuelly asked for more. I saved everything and when they requested the same information I sent it in again repeatedly.Tried to speak with someone about this issue and their was no response. Finally got tired of their non-repsonsiveness. Then they tried to foreclose unless we paid up to date and fee's as well which we did. This company is only out to take away peoples homes. If we could we would refinance with someone else but since we were told to not make 3 payments our credit is now bad.

I unwittingly signed up for the "trial period" for a loan modification with Nationstar. As I did not hear back from the agent named on the "offer" letter I began to research their program to see if I could find any information on their process. Low and behold....volumes of complaints on any type of related forum and complaint board. So I immediately just went back and made my regular payments. I denied their offer after finding out their tricks. (Remember...their "collectors" are not that bright). That made them hunt for anything they could to intimidate me. I have three fax numbers for them - bankruptcy (972-315-6757), foreclosure specialist (972-315-8637) and research (972-459-1611). When I fax, I fax all of them. I reiterate everything that was discussed in conversation as well as any response to any letters they send. I went to pay and the rep would not take my payment, said that there was a demand letter - I have not received it (of course), but found out how much is due and when. I faxed the rep asking to fax me a copy asap - to all 3 fax numbers! After what I've read I will submit complaints to FTC in Texas, State Attorney General (for CA & TX) to Consumer Financial Protection Bureau (I downloaded their listing so I can provide complain counts with my faxes), Texas Dept of Savings and Mortgage Lending, as well as a good number of the 488 state representatives. Now they're back-pedalling, saying that my last payment (a stiff "trial payment) was put "in suspension." In short, they're trying to steal the property, just as Saxon tried.

Also sold from BOA to Nation Star,which after research all numbers to call are owned by BOA. The first time we called the phone was actually answered BOA. So why does one terrible company sell to a worse company that they own? Seems fishy to me. Reports say headquarters are in Texas, so why does Elizabeth call and leave a message with a Fort Lauderdale, Florida telephone number , which after tracing belongs to BOA.

I am having the same problem here too. I was a BOA customer and now Nationstar.. I call 2- 3 times a day...nobody does what they say they are going to do. I document EVERYTHING.. they will NOT take my home. I have a loan modification with BOA and they state in their letters that they will honor it, Well we'll see. By the looks of things here... it doesn't look promising.

We had a loan with First Horizon. Since 2006. In February of 2009 I attempted to get a re-fi or a loan mod. I was denied both. After contacting First Horizon continually about a loan mod until Nov. 2009 going to NOVA Debt as I was told and then HOPE NOW nothing was done. I finally gave up and sent a letter stating I had followed everything they told me to do and I would no longer be making my payment. The letter was fed exed.
My husband continued to pursue the loan mod and we finally got one in May 2011. We paid $4500 up front for back taxes and insurance. My payments were made until January 2012. At which point we were sent back the payments, advised our NOTE was sold to NATION STAR. THEY lost the loan modification papers and put us in default. We hired an attorney in February 2012. We had a mediation, in March 2013. We agreed on an interest rate and we agreed to pay the back taxes and insurance from 2012.
Nation Star sent paperwork for either a payment down mod, or a NO PAYMENT down mod....however they wanted $13,670 as a down payment.
We suggested they show our payments made to give us an accurate down payment. All of this correspondence has gone through their lawyer, yet it is now JUNE and we have not been provided with any further current down payment.
The down payment breakdown they provided us did not add up to $13,670!!!
It ONLY added up to $8,786....we have yet to get an explanation of the difference. NOR anything regarding an accurate statement showing our mortgage payments we paid to reflect the taxes and interest. They are not corresponding with my attorney..nor their OWN ATTORNEY!!!! They are just plain crazy!!!

I have been getting a run-a-round from Nationstar since 2009, on a Loan modification. They have continued to request documents to
complete my modification, I continued to honor their request to supply more documents into 2010...they told me to send by fax, email and i personally Fed-X all documents after I faxed and emailed. I applied for a Hamp loan, i was denied, being unemployed at the time and having a hardship with my wife suffing from an Arota Dissection & major stroke but survived. I submitted (RA) form in this hardship as well as applying for a (UP)modification only to be delayed and misplacing of all documentations faxed, emailed, fed-x. Nationstar told me on June 6, 2013 my house was turned over to their REO department and offered my family $1,000 dollars to relocate, they told me & my family and to be out by July 21, 2013. I spoke with Nationstar REO rep. only to tell me he could not help me reverse the process, it was in the hands of the department, before it got to his department. So, i spoke with numerous folks in the department prior to the process reaching the REO department, and they don't know a thing u can't speak with anyone with any authority. I'm a man with a 4 year business degree and now work for a major corporation...how can Nationstar Mortgage in Lewisville Tx. get away with hiring a bunch of folks that lose paperwork mis-file, give out incorrect fax numbers, lose Fex-X sent documents and continue to put peoples lifes in disarray? How can they just take someones house of 7 years bases on notes enter into a computer screen by a...as for as we a untrained representative. I never tought i would see the day!

I have been trying to get a loan modification since October 2009. The first 3 years was with Aurora Loan Services. What a disaster that was! Then I was transferred to Nationstar. I am a 100% Disabled Veteran, therefore, I do not work, nor do I pay personal income taxes. They continually request paycheck stubs and tax returns, then asked repeatedly for the IRS form 4506T; 10 times and there are only 6 ways to fill it out!! I am eligible for HAMP and they finally approved me for a Tier 2 HAMP modification but only lowered my payments $200 and raised my interest from 2.85% to over 4%!! I would love to join this class action lawsuit! Wish there was one for Aurora Loan Services. I would join that one too!

Reading this is like reading my own story. My husband lost his job two years ago. In Oct of this year we started the process of a loan modification. Same thing.....lost all my documents, deadline not met, mailed them, faxed them. You name it; we did it. However, something in my head told me not to depend on them, so I always paid my house payment on time. I finally told them I was not interested in a loan modification. I'm so glad to listen to that "inner self." My heart goes out to you guys b/c I have experienced the same thing. It is a scam. I am still fighting with them over a 1800 "maintenance fee" that supposedly is from the previous lender. They have yet to explain what this fee it. We ask and they send a letter saying "maintenance fee." I called the former loaner who can not explain it either. I don't trust any mortgage company. They can tact any fee to your account.

Well everything is fixed. Although our payment went up slightly because of increase in taxes our payment is what it states on the 3/1/13 escrow analysis. This only took 3 months to correct. It only took emailing the COO & some other president plus a complaint to BBB & Consumer Financial Protection Bureau. http://www.consumerfinance.gov http://www.bbb.org I filed complaints on a Monday and within 3 days we were contacted by Taylor Pettigrew in the executive offices. I really feel for the customer who doesn't understand the mortgage business or computer savvy. I have 10+ years and it took a lot of digging online. This FB page was very helpful also !

We have been dealing with Nationstar for years. We have been digging out of a hole due to a job loss two years ago. Long story short we finally worked out a loan modification that took over two years to do so. The issue was that we could now afford the payments, but they tacked on the late fees and demanded them up front which we could not do. So we have been working on paying them off as fast as we can. We have never been 90 days late, but they decided to move us over to foreclosure status any way. So now they are demanding all late fees and payments in one lump sum or they are going to foreclose. They are not willing to work out any type of payment plan. I went over all my financials proving that we can afford the payments now, but they said all that did was confirm that after we pay the money due, which is two months mortgage plus late fees that they will let us roll our July and August payment together. So Kind! We have been trying to make our monthly payments but now they send them back stating that they will only accept all money due. They are not even thinking it through. Add all the attorney fees, on top of the mortgage and the home will definitely lose money in a foreclosure sale so they will just write off the loss. They then said that they had been trying to get in touch with me, which is not true, as I have phone records showing that I have not received any calls from then until just recently when they moved me into a foreclosure status. No written correspondence either. I could go on and on but this company is a scam.

Please help! Nation star is terrible, I've been paying my mortgage in a timely manner and they keep sending me demand letters every 6 .months. I file for a modification in January this year 2013. I called and w to check the status. every time I will call to check the status something else with me something else was needed. then the rep went on to say that the time process has ran this happened twice I sent them all that was requested. I've been on my job for 9 ys I faxed natio wn star all information that was requested. I was still denied a modification. please help ASAP

Bank of America moved my mortgage to Nationstar Mortgage. But when I made my first payment, they stated "Lender Paid Expenses $20,004.72(modification fee)".
Now my payment Total Payment Due is $21,229.81(include monthly payment amount). Why do they charge a modification fee (10% of original mortgage amount)? Bank of America never mentioned that fee. Is this legal?
I asked Nationstar Mortgage, but they never answered my question. Also I never received a payment coupon.
Can somebody help?

We have been in the modification run-around since January 2013. Every couple months, they make us fill out all the documents again, saying they "expired". They ask us to type up ridiculous statements for their clueless underwriters who apparently don't have time to actually read anything we send in. In May 2013, the filed foreclosure documents on us. Not only are we in the middle of a modification, but my husband is active duty military, and we are overseas on a PCS assignment.

I am also having the same issues with Nationstar, I was denied a re-finance even though our credit was good at the time. I attempted a short sale and have 7 offers for the home, 3 of them cash. They then denied me the short-sale in a letter. I then went to a deed in lieu of foreclosure, they are currently foreclosing on our home and sent me a denial of deed in lieu stating we don't meet the requirements. When I contact them they state the paperwork has overlapped ? I have been working on this since May 2012 and since left the home, and have had 4 representatives in the last 14 months. Please help.

I see an alarming amount of concerns/complaints regarding the HAMP process. I've been dealing with them for over a year and finally I was on track to have the modification completed after I was accepted and made the required trial period payments. They ramped up my income by over $2k a month even after I furnished them with our W2s, which cannot be disputed. I have appealed the payment calculations that were made and have received no judgment or response. I have been tossed around to 6 different point of contacts to date and none have been any help. I see an alarming amount of concerns/complaints regarding the HAMP process. I've been dealing with them for over a year and finally I was on track to have the modification completed after I was accepted and made the required trial period payments. They ramped up my income by over $2k a month even after I furnished them with our W2s, which cannot be disputed. I am in the same boat with everyone else. My BOA loan was transferred to Nationstar and I have been trying to get a Home Modification loan, to no avial...i.e. lost paperwork, expired paperwork, etc...too many excuses to mention. I then had a back injury that keep me out of work 3 mos...which I explained in great detail and now TODAY, I have received FORECLOSURE papers from an atty....although not ONE word from Nationstar about foreclosure. These people are horrible....and I can't get any help from them...you call and get transferred on on hold (in pergatory hold hell) and no one ever answers or calls back. Nationstar finally after spending over $2000.00in mediator fees, finally agreed to a HRMP, but after a few months , they kept saying we were a payment behind. Every time I tried to find out what payment did we miss, I got no response. So finally after a year They said we had missed two payments, I sent late , my fault, but it took them over two weeks to process it, after I told them I had sent it, and provided proof they had deposited into their Wells Fargo account. I never heard anything else. I now have found out a payment I sent to them for our May payment of 2012, was never posted to our account. I have since paid them an extra $2500.00, which I had to borrow from relatives, and have made payments to them regularly, but they are still hounding us, saying I haven't made our June or July payments. My husband is disabled and is on dialysis three times a week, along with other numerous health problems. I had to retire , because I came home from work and found him passed out to his blood pressure dropping to rapidly. I was told by a lady at Nationstar to get a job. We can't pay anymore money, it is all gone. We have lived in this house for over twenty years, and I want to stay in my home. We have nowhere else to go.

After a year of communication with Nationstar (AKA Bank of America) they finally informed us that we were eligible for a modification. We began making our 3 months of "trial payments." During that time frame, no correspondence was received from Nationstar. We continued to pay the “trail payments” after the 3 months were up. We contacted Nationstar, and they stated they would not send out the finalized modification documentation until we were able to clear title with the 2nd mortgage. We contacted Nationstar and asked if we had a timeframe to complete the required title documentation for the 2nd Mortgage, they responded with no timeframe, just as soon as possible. We began to work with the 2nd mortgage immediately. Three weeks later, we received a letter from Nationstar stated that our modification is no longer active due to title issues. They sent our home into foreclosure and referred us to their attorney. When contacting Nationstar, we explained to the representative that we were just informed 3 weeks prior regarding the tittle requirement and we were waiting to hear from the 2nd Mortgage. The representative stated we had 60 days to complete this requirement, and we failed to do so. We then requested for the notice giving us the 60 day time frame, they could not provide us with that information nor could they state when the 60 days began. Nationstar is doing everything they can illegally to make sure we lose our house to a foreclosure, we hope that a class action suit is brought against them very soon!

I have fought with Bank of America BOA since 2010 after losing my job during recovery of a double mastectomy (quite the injustice). I am a single mother of 3 children, 2 that are still residing in the home with me while working and attending school.

After years of being plagued by scamming correspondence (Which I kept all the correspondence and intend to send it all to the Texas Attorney General) and threats of foreclosure on March 26, 2013, BOA and I finally reached an agreement of $1048.34 Starting on May 1st, 2013 ( Fixed Interest rate of 2%!). Of course the loan goes through a ridicules 2053 (I would be 93) however, I can deal with it since I plan to sell in a couple years, after improving my credit due to BOA screwing it up!

The pain that I endured (yes, injustice again) when I tried to be proactive and honest was unbearable and I was constantly frothed with fear that I was going to get cancer again from all the stress.

Again after years of this torment, I was elated to get it all settled.

THEN they sell my loan to your company:
• I begin to get inundated with correspondence (just like with BOA)
• When I tried to make a payment on line I found out I can only do that if I pay Western Union a fee ???!!!
• Part of the correspondence said I owed you guys over $9000 on August 1st
• Also said that due to my ARM (I have a FIXED rate) my payment was going up $700+ dollars.
• Did you plan to change the conditions of the loan arbitrarily?


SO here I am again – getting physically ill and stressed out.
• Contacted your customer service ( Talked with Cussia Peterson after I talking to a couple others who were clueless)
• Clueless?? Why take over an account you are to service when you don’t have any accurate information.
• You sending me correspondence that is erroneous has caused me to be ill, physically and emotionally. Frankly I am fed up with this nonsense and no one is responsible???? !!!!!

I am PLEADING with our officials to PLEASE check into this company and how they are handling the already painful experience we have had with BOA to have to NOW go through all this with nation star is inhumane and criminal!! Somebody needs to pay for the pain and agony that BOA and NOW Nationstar is putting us through.

I am giving you a heads up. I am sending this to my senators, Obama, Consumer protection agency and the BBB again (I already complained to BBB because of the need to charge for making on line payments.) Greg Abbott (Texas AG) and ANYONE who would be interested in doing something about this fraudulent behavior- at least it all feels like fraud.

I already fought cancer once – this kind of harassment causes illnesses and frankly I have had enough! I am going to begin going after BOA and your company for debilitating mental abuse and harassment. I have been fighting with nationstar for nearly 7 years. I have entered into 4 seperate hamp modifications all were paid on time. When it came time to sign the permanent modification in each of the 4 instances nationstar sent me a letter saying that I no longer qualified for the modification, that the laws or rules regarding the program changed and I no longer fit their qualification guidelines. This tree month they offered me a large sum for relocation assistance in exchange for vacating the property. I am almost willing to agree just to be done with the nightmare that is nationstar.

Response Yes...Solution ---Is there really any solution?

Like some before, mine started in 2010 as a co-signer with a program as I understood was much like "Kiddie Condo" where parents help kids get in a home...only this was kids helping parent get in a home. This began with Countrywide as original loan, then to BofA. Started request in 2010...in December 2012 with BofA, was but a few days short of getting to the Deed in Lieu stage (following their horrid guidance through all of this) just to find out it was sold to Nationstar. I have all correspondance, notes of calls that truly expose what messed up nightmare this area is - trying to do the right thing to get through this situation, oh brother. Did I mention my Mother "Borrower" passed away September 2012...my wife, who has been stay at home mom for 7 years is listed as teh co-borrower and I must fight them every call to explain these fundamental issues to them - they won't even talk to me yet my Credit is the one getting tagged...messed up I tell you. There must be some benefits from the Government (in addition to BAILOUTS) for working us (and them) in circles...how much are they getting from/through government on these programs and NOT help truly work out these matters. I am near ready to expose this entire process as I am slowly squezed into no option but seek legal counsel, go bankrupt...is there really any option but retain a laywer or go bankrupt?????????

I have had the same issue with Nationstar. I applied for the making home affordable modification and was told multiple times that I qualified and they took me thru 4 months of Hell stating that I was approved only to tell me at the end of 4 months that I was not approved. They told me that I met the qualifications; that they were setting up my lower payment plan and I should get it in the mail very soon, Then I get a letter on a Saturday after the office closed to say I was not approved.
I then applied for a refinance and they took me thru 4 more months of hell stating that I was approved for that. At then end of that they told me that I had to bring 15 thousand dollars to closing and they attempted to charge me almost 8 thousand dollars in closing cost and I am already a customer. This is the most horrible company that I have ever been with; my mortgage was sold to the from First Horizon and they have attempted to change the terms of the loan several times; I do not trust them; they will lie to you and hide behind voicemails and emails and will do everything they can to to raise your monthly payment and seemingly force you into foreclosure. They recently made a mistake with my escrow account and raised my payment 425.00 per month from 1399 to over 1700 per month; I fought with management to get it lowered to a little less than 1600 because it was their error. My payment should be about 1000 per month with taxes and insurance. I have never been late with a payment and have never missed a payment and I do not trust them. Everyone who has applied for this modification with Nationstar should have been informed of this class action suit. When you contact management they will assign someone your case and work on an issue; but in the end they will only blow smoke in your face and usually nothing good happens to you on your behalf.

I have been going in circles sending all my personal information to have my account reviewed for a modification. During the last interaction I had with one of the customer service reps, he told me that they wouldn't even review anything I mailed to them. It took too much effort for them. I had to start the entire process over again, and now that they have all my paperwork, nobody will return my messages.

My loan was sold by BofA to NationStar in Nov. 2012, after agreeing to a loan modification before the 2nd payment was due. Did not hear from NationStar until the end of Dec 2012. Finally made contact with them in Feb. 2013, and agreed to apply for Make Home Affordable in Feb. 2013, Since then it has been a complete nightmare. We would give them a time we could be reached to discuss things (both full time jobs) and they would call when we were working. Then papers were missing and I email, faxed, mailed papers they said were missing, forms we didn't receive in the original packets, some I had never heard of before.This went on for a couple months and we would be told that the underwriters were making a decision. In April I found my home on a foreclosure site with a per-foreclosure auction date of June 4th. I contacted NationStar and was told that things would go foreword by as long as the underwriters were reviewing my MHA application that the sale would be put on hold. The the sale started hitting the local newspaper and for 4 weeks I called NationStar and was told that the sale would not happen as long as the underwriters had my MHA application. On May 29th I called the Auction Company and they told me they had not rec. a hold put on the auction. I repeatedly called, emailed, left messages with no response from NationStar after talking with the Auction Co. On June 4th I went to the auction, and discovered that NationStar called the Auction company with a starting bid of $218,000, which is more than the home is worth. After the auction I received a letter from NationStar that was dated the day after the auction June 5th, telling me that they still had my MHA under review and would have a decision by July 5th. I finally was able to speak to NationStar a different representative (the foreclosure representative given on the letters never returned a phone call to me) I had to deal with whatever person actually answered the call. After telling the new rep. the whole story he told me he would research and have an answer on a spec. date and time and he would call us, (I took off from work to be there for the call, which never came), when we finally made contact with him again, he said he did not have an answer and to call back in a week. After that we were unable to make contact with anyone again. On July 3rd we received or Cash for Keys with under 30 days to comply. We contacted the auction co. and told them we had been still waiting for an answer from NationStar on the MHA program and that we needed more time and was told to write a letter requesting more time, which we did and had it certified to the auction co. Still no formal denial from the underwriters at NationStar. We contacted NationStar once again got another rep to answer, whom told us as soon as it sold at auction it void the MHA consideration and basically that is all he would say to us. So we scrambled to find a place to relocate to and trying to move 24 years of stuff in less than 30 days. On July 31st (because we never rec. an answer to the request for more time) we called the auction co. that the Cash for Keys came from and requested more time and he gave us 30 days, that we have not rec. in the mail yet. On Aug 3rd we rec. a summons that a lawsuit has been filed against us by NationStar that we unlawfully detaining them from the property, that was filed on July 5th with the circuit clerk. So after 24 years and dealing with NationStar for the last 7 months I have lost my home and would like to know if there is anything I can do about it. If I had money for lawyers I would not be in this situation to begin with.

They have cashed my last 2 payments (as shown on my bank statements) but they do not show up on my current statement, thus they show that I am 2 payments behind. I just received a letter that I am close to foreclosure. I am given a phone number with an extension that is not the right person. This company should not be allowed in this profession! They finally after 9 months of being behind on our payments started foreclosure proceedings so we moved out . @ years later after the foreclosure is finaled and they send me a letter stating due to you rejecting any and all loan modifications we are forced to foreclose on your home . After , unbelievable . And now I am being sued for the balance , late fees , property maintenance but have been offered an option to make a one time payment of $325,000 to settle the matter . These people do not care about laws , have no business ethics and could care less about there customer .

Oh my gosh!! When I read everyone's stories it's like I'm reading my own. This is completely ridiculous that a mortgage company is allowed to get away with this. Our family has been through this situation with NationStar for over six months now and it's is one excuse after another with them. We were initially told they couldn't help us because we were never late on our payments and advised us to become three months late. They were definitely going to help us then. Against our better judgment we did what they requested. After the three months they conveniently lost our paperwork and needed it all resent again (of course, faxed). When we tried making payments to them they would not accept them. Seriously!! Who doesn't accept money? We are tired of the harassment of everyone at NationStar. I cannot even begin to tell you how many times we have faxed the exact same information to them. They will contact us and tell us we are in review for modification only to have them say they need more information. They definitely should not be dealing with people, our homes, and especially our hard earned money. I wish someone would step up and help the people of the United States and stop helping the big businesses that are ruining peoples lives.

In 2012 we have succeed to modify our loan, trough nation star, previous BOA. However what they called a "affordable loan modification. " It was not. Nation star reduced our mortgage payments only 180.00$ with adjustable mortgage rate, that after a short time we would be right back to square one, with the mortgage rate of 6 3/4%.
Because we can not make the payments on the 1st. of each month they keep harassing us constantly,during the grace period.
Initially they added penalties interest etc. so that after 3 years of paying mortgage my principal amount ended up being more than i owed before so called "affordable loan modification"

My parents filed for bankruptcy. They decided to try keeping their home with a loan modifaction. After being several months late they asked Nationstar for a loan modifaction. They received a letter in the mail letting them know if they complied with the trial period of three payments they would get a modification at 4 percent for 40 years fixed. It said by sending the first trial period payment they are agreeing to the modifaction stated in the letter. We called the number they said it was guaranteed as long as the trial period was paid on time. Asked for it in writing they told us the letter we received was proof in writing. After the trial period was up my father called Nationstar to see what the next step was...they told him they have no record of him doing a loan modification and they are currently in foreclosure! Nationstar has cashed the 3 checks. Can they do this or has this happened to anyone else?

Nationstar did me the same way several months ago; I applied for the Modification program and was told repeatedly told that I was approved and after about 4 months was told that I would be getting my new lower rate in the mail and after repeated lies and months of faxing in bank statements, and a multitude of other data; I got a letter on a saturday afternoon when the company was closed saying I was denied because my income was too high even after being assured that I was approved. I was so disgusted I did not know what to do.
Months later I applied for a refinance and was approved and waited another 4 months for closing; I have some back taxes that I am paying with each payment and was told that those taxes could be rolled into the new loan. At the end of 4 months I was told I would have to bring over 15 k to closing as the taxes could not be rolled into the loan; in additon to that; Nationstar wanted to charge me over 7 grand in settlement charges; so if I paid the 15 grand in back taxes plus 7 grand in settlement charges; it would cost me 32 thousand dollars to refinance my mortgage. Does it not sound strange that I was denied the loan modification that had no settlement charges yet approved for the loan that would cost me 32 thousand. Nationstar is a train wreck about to happen; they are going to get shut down one of these days and it may be good for us all to get transferred to legit mortgage companies

My husband and I are having the same problems with Nationstar they bought our mortgage from Consumer Real Estate Financial. When we turn their names over to the BBB someone called and denied knowing consumer mortgage and said they did not have our mortgage; but, they have been sending us packages in the mail trying to get us to sign a new contract when our rates were already locked in. I have been trying to get NationStar to process Loan Modification which we are more than qualified for per Govt guidelines, however they have been delaying us since June, and it's now October. They contacted us a few weeks ago, after about 12 weeks or so of "processing time" only to say we had incomplete documentation and missing paperwork. You can not get anyone via telephone, or email. First off I had file bankruptcy in June of 2012 my bankruptcy close in late December OF 2012. Even while in bankruptcy I have been trying to get a loan mod considering my situation, since then bank of america was move to nation star so pretty much had to start process over then it just got more difficult gaining anywhere with them, mainly the problem is they ask for the same things over and over again and hit me with everything over every 90 days its now got to the point where they have referred my mortgage to a firm for FORECLOSURE as if I aint attempting to save my home which is unfair, and that's all I want is to save my home. Since then everyday I have been on the phone with nationstar going over everything they have ask for and everyday I get something new instead of maybe in the first place asking for every document I may need to place my loan in review which to my knowledge may stop foreclosure. I spoke with the foreclosure office Sage Point Lender and they indicated that our home is scheduled to be sold October 21, 2013. They stated that Nationstar has not indicated otherwise. We have been providing Nationstar with all the necessary documentation and every time they ask for more detail or the same information. We feel that they are giving us the run around since every day they ask for a new document stating that the last provided wasn't good enough. We are still waiting to hear if our loan modification has been approved. Nationstar states that we are not even in the review process yet they have sent us foreclosure and our house is scheduled to sell in 10 days. this is a nightmare I will do whatever it takes to keep my home and make an example of this company??

I have a long story.... but since they took over my loan from BOA on 7/1/2013 - I have spent SO much time trying to straighten them out- Nationstar is the reason PUNITIVE damages should exist. After fighting with them (I have a fix not an ARM) they proceeded to tell me I'm behind and send foreclosure notices. They just sent me documents now instead of owing 74K I only owe 2 payments (NOT) so I have been fighting over that now they say I am behind by ONE- based on their own documentation they just sent me - I DON'T!! I think all this mail they send us and it's incorrect - is fraud! Nationstar is corrupt...we all know that...they have put me through hell for the past 3 years, and it cost me my marriage and my health! I had never missed a payment with Citi...but they sold me down the river to fanne who farms you out to Nationstar...a debt collector...(or loan sharks) just because I asked for a GOOD-DOOBIE "motification" Why, is no one listening?? I contacted over 60 agencies and individuals about this company...including HUD the Treasury and the FBI!! My senator has been useless. Check you foreclosure papers carefully....no promissory notes...no foreclosure...and NS is notorious for that!! There needs to be congressional interference to get these creeps out of business.....and we all know how efficient they are!! We need to get together and make them listen. On Friday, Oct.18th, at exactly noon time...everyone fax your complaint letters to your senators office...and then fax it to the treasury and your local FBI branch....bombard them with this information all at once...then call the CBS I team...they have been looking into this with atty Roy Oppenheim...I suggest you go to his website and LEARN your rights!! I am going on 5 months now, trying to get Nationstar to modify my loan, currently at 6.2% interest rate, on my upside down mortgage of $50K. We did a temp modification 3 years ago, paid 2% just fine, so it's obvious we are qualified and can handle it, but they don't seem to want to assist. They have indicated "missing paperwork" at least 3 times now, which takes them a month or so to let you know. In the meantime, I am slipping into foreclosure zone as we are now almost 4 months behind as the monthly payment hiked up over $1,000/month when it adjusted to 6.2% in June 2013. It's impossible to get anyone there to dedicate any time to me.. I have been searching for legal representation, but that too has proven to be frustrating as it seems they all want "upfront payment" which I have read is illegal. So, what do we do? How do we sign up for Class Action? I'm IN!

Just got letter from homeowners Insurance saying Nationstar has not made payment to them . looks like Im headed down the same road as everyone else . I not going to send them more money for something that should have been paid for. This is not a poker game , Im in for the class action

I tried doing the making home affordable program twice when I was unemployed for a few months. They would always lose my paperwork in the the mail or via fax. I finally gave up and stopped paying my mortgage and got an attorney. He was going to make a agreement to give them the house if they do not penalize me. Now they are asking me if i still have an attorney....I wonder why??? I feel my attorney could of done more so I am seeking new counsel.

We were denied once, them saying we didn't give them info they requested by the requested time, but we did several times. Now they are trying to do the same thing. We could use some help.

Word to everyone. My honest impression is that Nationstar wants us all to go into Foreclosure and will do everything they can to drive you there if you get into any kind of trouble. They lied to me for months saying I was approved for the Modification loan and turned me down on a Saturday afternoon by mail after the office was closed,. Then I was turned down for a refinance after saying I was approved; they would however approve me for the refinance with 15 thousand down and about 10 grand in closing cost rolled in so for a cool 25 grand; I could get a Nationstar refinace. Beware of this company, they are not on our side.

I was contacted by Nationstar that they could assist in a loan modification. Their delay in processing paper work by more than three months caused severe financial distress with their internal staff and foreclosure proceedings by National Star was reported to my credit. After six months delay the staff at Nation Star completed the modification paperwork however the modification loan of $385,000 approximately has a balloon payment of over $90,000 if I sell my home today in addition, therefore, if I sell my home today, I must pay Nation Star interest for the life of the 30 year loan at closing now. I owe Nation Star $468,000 approx today if I sell my home.

HELP!!! Ok here it goes, I am about to scream, after hearing all the families in jeapordy of losing or has already foreclosed is awful. I have been given the run around with this modification now that I was told the I was approved now called to find out that is not so. And after reading the post I dont think it was ever so. I have saved my home before with thousands and now the same thing again. I feel that this is a no win situation with Nationstar and before its all said in done they want our home anyway. But I refuse to give in to this madness. I will not lose my home and I would not be bullied by Nationstar. You guys have given me hope to pursue an attorney against this company. Because even if I pay to catch up this mess whos to say they wont come with something else. I feel that this company is a huge scam. So they bought $213 Billion mortgages for $1.6 Billion from Bank of America so no telling what other companys sold the mortgages as well. So they really don't have anything to lose and forcing us to foreclosure. They will win regardless. So we will not give in to Nationstar. I am on the look for a great attorney to help us all in this class action lawsuit. So if anyone find an Attorney please post the information here. Please families don't lose hope, we all got stuck with this, lets help each other save our homes, finances, and families.

I hvae been dealing with Nationstar since my husband lost his job in May 2013 and they didnt want to help because I was current. In July 2013 submitted my modification papers and was receiving calls from collectors telling me it would not get approved and just short sale it would be better. Was also receiving letter telling me it wsa being reviewed and we will get back to you. so now we are in Nov 2013 and still no news and calls keep coming and late fees added but no resolution. I'm scared to give them my hard earned money and they still foreclose me after I have paid them for over 2 years and their website says they can help with hardship / job loss and nothing has been done. This is false adverstisement......Hopeful Mom

I too have been given the run around. It has been almost 2 years since Nation Star told me my house was going into foreclosure. I had gotten a mod and then my wife lost her job. The amount I tried to negotiate was about 100 dollars less than the first agreement. I sent hem all of my documents several times and they would always tell me they never recived it. The last time I called they told me that the house was going into foreclosure and that was almost 2 years ago. On top of me being told the house was going into foreclosure I certainly did not want to be kicked out so I did what any normal frightened human would do. I moved out and today there are squaters living in the home. What recourse do I have to either have the home taken off of my credit report or move back in. They lied to me and said the house was being forelcosed and did nothing to help with the modification. Please call me or email me. This entire situation has ruined my credit and is keeping me from keeping my security clearance and having a decent credit score. Please help me.

Today, Sunday morning 8:30 a guy is banging on our door serving us foreclose papers. We were approved for a modification that we never applied for September 28. The letter is dated August 14. 1st payment was due September 1. I called them September 29, sent a payment October 3, November 1 and the October payment they never credited to our account, they said it was for legal fees. November 29, they withdrew the modification approval and now we are in foreclosure. We have > 200,000.00 in equity in our home, with a bad market. I cannot believe this is happening. Our loan was acquired in March by BOA.

I see Nation Star has been going at this for years. This truly is sickening!!!! Ok, so my bf and I broke up and yes, a decade ago if you got a mortgage loan and couldn't pay for it, you were foreclosed. Well now the government has give these banks money to implement programs and they aren't following through. For four years, yes four years, I have sent paper work in, I have had contract on my house, I have bent backwards for these mf'ers. And what have they done....LIE!! They first said a Quit Claim Deed was needed because myself and the co borrower were no longer in a relationship. When their own lawyer called them out on that, they changed their tune to, we have never received any paper work. We had no idea the home owner was interested in a short sale. Then, after getting the realtor on the phone while at mediation, they miraculously found the paper work. There's more bs to add on this. But, I will spend my entire life googling, and doing research until they pay for their incompetence. I am sorry for everyone who has had to go through this. God Bless.

Same problem here. I was working with a loan specialist from NationStar who informed me via email and phone call that I was able to get a loan modification and that since they were going to work with me on a loan modification our home would be taken off the foreclosure sale. When I went to court to tell them this and that I was trying to hire an attorney, the NationStar lawyer proceeded anyway and said he had no knowledge of this. I asked for a new trial because I did not have an attorney as required in SC and the Master in Equity went along with NationStar counsel. The $800,000.00 loan was put in my wife name only while I was out with Cancer. My wife is a school teacher who makes approx $40,000 a year. The interest rate was 8 1/2% and drained all of our savings and killed equity in our home as the 6 or more modifications we went through would only demand we fill out dozens of documents then take a large fee to modify our loan before denying our modification and making us apply again. Our home went on the foreclosure sale but no one purchased it. The bank retained ownership and who know what that means. We are definitely interested in a class action

Lo and behold, BOA sold my account to NationStar .
Got a letter from NationStar last week asking me to buy insurance for that house ! Which I do not own nor live in. Said in the letter, that if I do not pay, the monthly mortgage payments will go up !
I won' t pay, of course.
Will the new owners get foreclosed because I won't pay ?
Motto: Buy a foreclosed home, make the payments on time, and still get screwed by NationStar because the former owner will not pay....

I am appealing the denial of my mortgage modification. NationStar provided a vague reason.

I have asked to see the numbers and calculations used to come to this conclusion.

I called on February 19th, someone named “Lauren” answered the phone but claimed that she was NOT the “Dedicated Loan Specialist” assigned to my loan and that Lauren Dunmon was not available at the moment.

WOW!!!! What are the odds that the extension belonging to Ms. Dunmon would actually be answered by someone working at the same company with the same name?!?!? My guess is that ALL of these “Dedicated Loan Specialists” are “Dedicated Loan Specialists” in name only to dupe the consumer and that these people don’t exist and/or do not have the training necessary to be “Dedicated Loan Specialists”!!!

Similar to all other posts above... we tried 5 times over 5 years to refinance our loan with Nationstar. All times denied. We had a buyer in place to shortsale our house and they still foreclosed on us. It is very disappointing and upsetting. I would love to know if anyone is pursing Nationstar in a class action lawsuit.

I am in Bankruptcy and trying desperately to save my house. Nationstar is the mortgage holder and they bought the loan from Aurora Loans. We have been making our bankruptcy payments faithfully for over a year. Nationstar has denied us a loan modification due to (and I quote) "it would increase our payment". Our lawyers asked for a meeting with the judge and Nationstar rep. The judge asked the Nationstar rep to go back and see "what they could do" to try and help us. There is a letter, dated the day of the meeting, addressed to my lawyers that says that they will "modify" our loan on a trial basis to an amount $800 a month more than what we are currently paying. When I asked what calculations this was based upon, my lawyer said he had no clue. If we cannot make the payments, they will foreclose on our house.

People talk about about predatory lending, but this is predatory foreclosing.

Points going around in my head:
1. Foreclosure or short sale gets properties off their books in the shortest amount of time and servicing. This is what we are getting pushed into. NationStar has shown NO interest whatsoever in "servicing" my loan.
2. Nationstar most likely bought these "bad" loans at a great discount. They are making money hand over foot by throwing people out of their homes. I am interested in joining a class action suit against Nationstar.

We applied for a modification with boa before they sold loan to nationstar. We were told on dec. 10 2013 by BOA that the packet was complete and in review for modification. 2 days later the loan was sold to nationstar. BOA said not to worry, nationstar would finish the mod. Nationstar stated they knew nothing about a mod and we needed to re-apply. We did, have been turned down twice by nation star and told the investor of our loan does not allow any form of modification and that we are now 18 payments behind. We have not missed any payments.

Nation Star is sincerely trying to keep loans locked in their current rates by committing fraudulent activity... customer service is by way of website only and they intentionally will report you late when they acquire new loans from other mortgage companies. How can they get away with this? I need a Lawyer ASAP!
