Mercedes named in class action lawsuit over defect in the 722.9 7G-Tronic automatic transmission

Plaintiffs bring this action on behalf of themselves and all other similarly situated owners and lessees in California of Mercedes Benz automobiles equipped with the 722.9 7G-Tronic automatic transmission.  As detailed in the complaint, the subject transmission is defective, having a defect in the transmission’s valve body and conductor plate that causes the transmission to fail prematurely and need replacement well before the useful life of the transmission or the vehicle in which it is housed.

As alleged, Defendant Mercedes-Benz USA, LLC (“MBUSA” or “Defendant”) has known about this defect for years, circulating internal Technical Service Bulletins to its factory-authorized dealerships that detail the nature of the transmission problem. Indeed, the defective 722.9 transmission has failed to such a widespread extent that, at one point, MBUSA was unable to supply sufficient replacement transmission components to have the defective transmissions repaired and, as a result, for a long time, MBUSA prevented independent service stations from purchasing such replacement parts.   Worse yet, when the transmission valve body or conductor plate fails in the Mercedes-Benz 722.9 transmission, a real safety hazard ensues.  As a result of the defect, the transmission will have a difficult time shifting from first to second gear, and will not shift to higher gears, causing the vehicle to be unable to be driven at any speed.  The fault will then cause the transmission to enter what is referred to as “Limp Mode,” leaving the car to “limp” along the roadway in a very restricted and limited fashion.   Despite this and despite the clear defect and Defendant’s knowledge of it, MBUSA has failed to take any action.  Because the defective transmission typically manifests itself outside the 4 year/50,000 mile durations limit of MBUSA’s New Vehicle Limited Warranty, MBUSA washes its hands of any liability, fails to disclose this defect, and leave consumers of the affected vehicles, like Plaintiffs, to pay for the costly repair of the transmission to the tune of several thousands of dollars.

Plaintiffs, who own a 2007 Mercedes-Benz S-550 originally equipped with the defective 722.9 transmission suffered this fate, had their vehicle’s transmission fail repeatedly on the roadway when the car had just 57,000 miles or so, and were denied any consideration by MBUSA.   Given MBUSA’s failure to stand behind its product, Plaintiffs were forced to and did pay over $2,000 to have the transmission valve body replaced.  Needless to say, transmissions in cars having only 57,000 miles should not fail—much less should they fail by the thousands in Mercedes-Benz cars across the country.  Plaintiffs file this lawsuit to seek redress for MBUSA’s violations of the California Consumer Legal Remedies Act (“CLRA”) and California’s Unfair Competition Law (“UCL”).

2006 M-B c230, balance shaft replaced at 77,000 miles thanks to the class action suit that Mercedes-Benz LOST. 722.9 transmission starting failing around the same time. I just put my C300 sport 4 matic (2009) in the shop. Transfer case is broker and can only be repaired by replacing the transmission and Turc convertor. Over $6200 with labor and that is from a certified MB shop not the dealer. The mechanic said that MB clearly know about the problem. They get a lot of them.

My 2006 Mercedes Benz E350 keeps going into limo mode. I was forced to drive my car to work and would just shift to neutral to shift through the tough gears. My quick fix didn't last long and the car is stuck here at home now. I am currently still paying on my car loan and the car is ruined. Found out it is my valve body and it will cost me $2,745.36 that can ONLY be worked on in the Mercedes Benz shop which is so stupid!! I do not have that, and this car is my only way to work. Currently I haven't been to work in 2 weeks because of this problem. This stupid car ruined everything. Oh and Mercedes doesn't have a payment plan you can get on to help with such a large cost.

While driving home, my car went into limp mode unexpectedly and would not allow my to shift. I used my scanner to check the transmission codes. They are 0748, 0778, 0798, 2716, 2725, 2734, 2810 and 2759. Considering it is highly unlikely that all 8 solenoids fail at the same time, It seems that the conductor plate is likely the culprit. Why is this not being addressed? This could cause major safety hazard for me and my family while driving at highway speeds.

I own a 2006 ml 350 with just under 100,000 miles , check engine light came on and the car will not drive past thirty miles an hour, scanned for codes a found a po717 code reading speed turbine a no signal. Before the check engine light came on had times where the truck would get stuck in a high gear when I came to a stop, resulting in the suv struggling to take off. I would shut the car off and turn it back on and it would be fine but now it just stuck in first gear, same issue with the contact plate.

I have a 2007 s550 I purchase it at 51,000 miles after my warranty went out 30 days it has the same problem going in to limp mode it has done it 20 times I purchase the car in April 2015 some times you get of the freeway and slow down it will start Jenkins and will come to a complete stop let it set for 5 minutes start it back up no problem never no when it will stall I will not let my wife drive it is have a 2004 s430 4 magic my wife drive it has never stop are had no problems like the s550 I wish i never purchase this car thank you

and with over 25 years in the auto repair business, i know what the issue is and the dealer wont even sell me the part so i can do the repair...
they want me to bring my car to the dealer and charge me full blow price.i'm a A.S.E certified master tech that worked exclusively on imports and had even owned my own repair shop at one time
no way i'm letting them touch my car
its a hour repair plus parts and transmission fluid and five min of initializing with my scan tool

Acelerating from a stop light and the car will sometimes get stuck in 1st gear, pull over shut car off and back on and its good. Has been doing this very randomly for a year or 2. Every few months it will happen but seems to occur more often lately. My father in law also had the same issue in his 07 ML350, it cost him around 2000 to have a transmission shop to replace the valve body. Just recently did the Balance shaft on the car MB covered 37 percent of the repairs on that job due to another class action. Hoping this one works out, seems very common with everyone I know that has a similar MB year and model.

2007 C230 68,000 miles same problem. I had my conductor plate rebuilt in Los Angeles by Module Repair Pro listed on Ebay. Cost was under $300. Add M/B approved transmission fluid, gaskets, pan bolts, and filler tube and you are out about $600 in parts. Labor should only be no more than 2 hours.

This occurred to my wife just this week and of course when in out of town. We have a 07 gl450 110k and it just up and stopped for no apparent reason. Let the car sit for a few hours and presto works fine for 10 min. Then bam stick again. I spoke with my mechanic he said there was an open campaign on the problem and he specializes in mercedes/BMW told me the only thing to do was to contact the dealer and try and remedy it that way.. 2006 ML350. Dealers replaced conductor plate and valve body. $2800 out the door. The service advisor reports they get a steady flow of these weekly. Although replacing the plate is almost half the price of replacing the valve body assembly it's recommended to replace the entire assembly if your + 100k. Hard shift problems may occur if you don't. MB will not replace a conductor plate only on a ML350 with + 100k miles.

2005 SLK55 AMG - 63k. While driving the transmission will stick in whatever gear I happen to be in and will not down shift or up shift. I must pull over and recycle the ignition but the problem will often return before I reach my destination. This can be quite dangerous depending on roadway situations.

1)Remove transmission oil pan and capture all oil in a container to later measure. 2) Remove valve body. 3) Remove TCM (transmission computer module) from valve body. 4) Send just the module to www.ModuleRepairPro.com via EBAY for $ 269.00. They will fix module and send back to you . Follow replacement instructions from Youtube, 10 liters of Oil , gasket and filter can be purchased from Ebay. I'm back on the road and it feels like a new car again. 2007 E-350 with only 59k. I was in full limp mode and had a ( P2768 ) error code. Had to pay the MB Dealer $150.00 just to tell me the error code.
Option...you can fix all 722.9 problems but you will still need to have a shop or the dealer clear the error codes. I cleared my codes with a MB II dianostic tool bought on Ebay. I refuses to give the MB Dealers any more money.

2006 E350 with the 722.9 conductor plate going out at 125k. Transmission was serviced according to manufacture spec. The car always had some jerky shifting between gear 2 and 3 before it completely broke down. **** 12 days ago I made a chime in here.**** I fixed the problem myself, you can do it too. The problem is likely to be the TCM transmission control module. No need for any special tools. Important to measure the fluid you remove from transmission when you drop the pan. Follow Youtube videos. To refill transmission use a pump ( like a large syringe ) that can be purchased from Walmart auto department or Harbor Freight . Use the pump to refill the same amount that was removed when the pan was dropped. Note..make sure to use the proper transmission fluid for the 722.9 . I used approx. 8.5 litters. Transmission on my sl500 had same problem. Dealer wanted $7000 to replace transmission. After complaining to MBUSA, price came down to $4200 for remanufactured gearbox - that at 42000miles!

2006 e350..... MB wants $7000 to fix. Turns out the problem is incredibly widespread. We bought the car used....problem started right away. The little dealer promised he would fix. 9 months later here we are and he has done nothing. We initially took a grand to fix the car. It did not work. Now he wants to give the grand back and the broken car. Nine months worth of promises gone. He for sure is not giving back the $2500 down back or helping us end the loan he set up for us. My 2007 gl450 is sitting in the auto shop. Mercedes Benz wants 8700 for a new transmission. I only had 113k miles on it, owned less than a year and had done all up to date maintenance on it. It needs a new valve body and conductor plate, but if I get a used one MB won't program it. I can't afford their prices for repairs on a transmission they KNOW has issues. As a result I ended up buying another car while this one sits at the shop with no hope and still making car payments for three years!

****90% Solution for under $ 400.00 **** VERY IMPORTANT
1) Remove transmission pan and capture all oil in a container to later measure. 2) Remove valve body. You can follow YouTube video at this point. It's like removing a shoe box. 3) Remove the TCM (transmission computer module) from the valve body. It's black plastic plate that contains the module.
4) Send just the module ( plastic plate ) to www.ModuleRepairPro.com via EBAY for $ 269.00 . They will fix the module and send same part back to you. 5) I cleaned the valve body, parts, and oil pan with brake cleaner and air dry. 6) Drain torque converter. A very small allen screw. 7) Make sure to measure all oil that was removed. That's it. No special tools needed. DIY
I'm back on the road and it feels like a new car again. 2007 E-350 with 59k. I was in full limp mode and had a ( P2768 ) error code. Optional..Buy a MBII diagnostic tool from EBAY so you can clear all error codes. MB dealer will charge you $ 150.00 just to clear the codes for you. The tool will do it for you. It's a handy tool to keep with the car. After all is put back together you will need to use a pump bottle and a plastic tube to refill the transmission. Same method as putting oil in a boat motor lower unit. Just remember to put in the same amount of oil that was removed from the transmission. I used about 8.5 liters. Drop a line to me if you need any help or just to say thanks.

2008 E350 4matic. Hard downshift typically from 3-2-1; although there is some significant lag and kick-in from 1-2-3 with aggressive acceleration. Side note: Transmission fluid specs from MB are 'lifetime' (i.e. never needs changing), only to have transmission fluid change recommended by MB service tech.

I bought my car about two weeks ago. 118,000 miles.
I had my first weird mechanical problem with the car tonight. I was making a U-turn and midway it seemed to go into Neutral. but the shifter was still in Drive. I slipped it into neutral, back to drive, nothing. The engine was running but had lost full momentum. The cars behind me were at a red light. While it was in Drive, i toggled through all the drive gears, 1-2-3-4-5-6 and back to D. Still nothing. I put it in Park, turned off the ignition and on again. put it in Drive and it took off just fine.
It's been doing it ever since, twice on the freeway when I was trying to pass another vehicle. I had to pull over to avoid being struck.

I had the same issue with my 2006 ML350 with only 92000 miles on it the vehicle went into LIMP mode while entering a major interstate highway nearly causing a terrifying accident. MB USA restricts the repair of this "mfg defect" and it must be repaired at an MB dealership. The problem will not go away unless repaired. I made MB USA aware of the issue and they denied that any issue exists. I filed an official complaint with the NHTSA so as to alert them that a recall is necessary. It is very easy and can be done on line in a couple of minutes. According to the NHTSA spokesperson, if enough complaints are filed the vehicle issue will be subject to a recall and MB may have to reimburse everyone for repairs. My repair cost was $1500.

Once they get to 500 they start the official complaint process with MB USA. I have a 2012 c300 4 matic and is sitting at the dealership with a failed transmission at 53,000 miles, the regional office states they are not responsible for the repairs at the tune of 14,000 dollars bc I didn't have my routine maintenance done at MB, even though it was done and I have all the documents to support this. Our local service garage alerted us that there is a service bulletin out for this transmission which is the step prior to recall. I am not giving up on this but any information is helpful. I have a 2006 MB E350 with 138,000 miles. Just had the fuel tank replaced due to serious leak making it a virtual Molotov cocktail. Now it frequently fails to shift out of first gear when accelerating from a stop. Engine hits over 6000 rpm before I can pull over, turn off engine and restart car. That temporarily fixes the problem - i.e., it now will shift through the gears until problem reoccurs, possibly even the same day. This is VERY dangerous condition. If not able to pull over immediately and stop car this could result in engine failure with car stopping immediately in the driving lane resulting in rear-end collision.

Same issues on a 2006 c230sport sedan if not for the quick thinking of a couple other vehicales on the highway would have been rear ended at a bout 80mph punched it getting onto highway and sidedly it feel flat on it face wouldn't pick up speed infact lost speed and very high rev rpm. Lucky the Audi was paying attention and got around me and the BMW behind him cam within feet of hitting me while trying to get off of the highway .it is a split second to miss me will it took me a few seconds to get into the shoulder they both stopped to check on me to make sure I wasn't having a medical problem only to find it that it was a car problem and it wouldn't pick up speed. Got it home next morning start put in gear and it shod through all gears but would not even grab in the gears to roll put on jack stands and it would roll that way only this could have left me in very bad highway wreck.this car has already had to have balance shaft problems fixed at my own expense 87000 tops they claim wear and tear .remember when Mercedes was not even broke in till 75000 miles now it is the life of the vehicale

2006 r500 start to shift hard about a uear ago then finally it just locked up and all the trans fluid poured out. I had the tranny rebuilt a year ago but, the shop didnt replace the solenoids or valve body. The crankshaft sensor went so the car sat for about 8 months. 2006 C230, although dealer says it has a 2007 model year transmission in it. I purchased the car used. Experienced a lot fo the same stuff. Didn't originally understand the problem when it started. Thought maybe I hit the gear shift or C/S button and did it myself. The first couple of times the gears seemed to stick, but I also realized it "fixed" itself if I stopped and restarted the car. Was on my list of things to do. Then the car went into "limp mode" after a local errand. Car is in the shop right now, having valve body replaced. Bill to be about $2800. The shop confirmed, although they didn't know why I was asking, that it is that transmission.

I have the same issue with my 2004 Mercedes SL500 with 70,000 miles. It went to low gear and fails to come back to high gear. I took to the auto shop, the diagnosis was that conductor plate needs to be replaced. Because it is a "nag 1 version" the valve body must be replaced with it. The cost of the repair is $1699.00.

I have and had the same issue with both 2006 C230's. The transmission has failed on both and it hasn't been cheap. It's pathetic that we allow mercedes-benz to get away with such irresponsible crime. Families are at risk. We need to revoke their business license. See if that hurts their fat wallet.

During a routine 75,000 mile service appointment for my 2010 Mercedes E350 on March 8, 2017, my car was retained after being diagnosed as having a serious peoblem impacting safe driving. Specifically, both the transmission and rear differential required replacement. I purchased this automobile new in September 2010.

I also have the bad conductor plate issue and started in my 06 Mercedes w211 e500 which when taken to dealer and vin ran has the 722.9 transmission dealer only part. Car was only at 59,000 miles when issue when taken in for but not fixed. I habe since ben in a wreck because of the vehicle dropping gears and insurance claim done but the conductor plate is mechanical which the insurance will not pay as well as the air struts going out but fix the body from the wreck and i paid to fix air struts and conductor plate issue still remains. Dealer advised me to get a scan tool which i did that resets the transmission temporarily but is becoming a shorter fix. What a great car if they only backed there car and design issues to a decent amount of time but 55,000 is outrageous. No decent discount and only a dealer part ?

2006 Mercedes w211 e500 56,000 the problem was diagnosed at a dealer for a dealer only part and waa too much so now i have a big paper weight in driveway that i have to reset every day with a scan too that way it can be driven short distances and cause a wreck again which is documented by insurance company and Mercedes dealership of struts going out and transmission droppimg gears im traffic and limp mode causing and accident which my insurance company fixed body but air struts and conductor plate issues remain because are mechanical.. currently at 65,000 miles and can only be driven a few miles at a time and can not be sold because of issues but yet because of paying for the vehicle can not buy another ..dealer only part really on a car with not many miles but issues start 4,000 miles past warranty ends

2007 ml 350 have same problem. goes into limp mode when coming down from high speed, ie. highway to off ramp. just started today will go mb dealer tomorrow and see what they say.

Experiencing the same issue at traffic stops. It won't shift gears out of first. Have to restart the car and it works fine. Happens almost daily now. Problem is there are no error codes! Dealer suspects valve box and quoted $1500 repair.

Have the same issue with my 2007 S550. Dealer wants almost $3000 to fix. Took it to an Independent mechanic he quoted less than a $1000. Here is the catch, I needed the conductor plate and MB wont sell it to me nor can the mechanic buy it.

2007 Mercedes Benz E350 with 722.9 tranny. Experienced limp mode 4 times already the last 6 weeks. With only 62,154 miles. Very scared to ge rear ended. MB should at least help the owners for the repairs. Quoted $1,500.00 for conductor plate, by Independent MB shop. I hope there will be a recall for this. I have seen a lot of issues with 722.6 tranny. My 3rd and last MB.

I own a 2006 R350 with 3.5 litter engine, the transmission is in limp mode and dealership will not see the part. My mechanic say that all the DTC are pointing at the Conductor plate. called Mercedes Benz dealer they will not sell the part and want me to tow the car to their dealership for replacement of conductor plate and valve body $2000 or more. The whole fucking thing was replaced 2/2/2009, now Mercedes Benz wants to charge again to replace it. I would like to participate in a lawsuit to have Mercedes sell the parts to aftermarket shops. This is America (the country of free enterprise) either Mercedes Benz cough up some dough and repair these issues on their piece of shit vehicles or allow aftermarket repair shops to purchase the part.

I am having the same issue. C 230 2007. Car does not accelerate and I can not drive more than 30 mph. Engine works high RPM and I jerks hard changing gear from P to D and even worse going from P to R. Went to a local shop, they said conductor plate need to change and they need Mercedes to set the computer after repair. Do not know what to do. Mercedes is 2000+. My mileage about 90K

I have a 2004 SL500 with approx. 86k miles. Transmission failed while driving on highway almost causing a serious fatatility(me). My mechanic informed me that I need a new valve body as the codes are lighting up all over the place.

I have a 2005 e500 with 100k on it i have similar issues as everybody here i took it to a shop and they said my valve body and my conductor plates are no good my car is stuck on 1st gear .
