Plaintiff brings this action against Kia Motors America, Inc. (“Kia” or “Defendant”) for injunctive, equitable, and declaratory relief on behalf of herself and all other similarly situated owners of 2001-2006 Kia Optima automobiles (“the Class Vehicles”).

Plaintiff  is the owner of a 2003 Kia Optima automobile who began experiencing difficulty with the door locking mechanism on the front driver and passenger doors.  At first, after unlocking the doors with the key fob, merely touching the door handle would trigger the doors to lock preventing ingress into the vehicle and necessitate a manual unlocking of the vehicle from the outside.  Concurrently, the Plaintiff was no longer able to unlock the doors from the inside of the vehicle and could only do so from the outside.  On more than one occasion, as a result of the Door Lock Defect, Plaintiff was locked into the vehicle and could only exit by climbing over the front seat into the back of the vehicle and exiting the rear door.  After having been trapped in the front of the vehicle, Plaintiff could no longer take the risk of locking her vehicle while driving.

Over the next few months, even manually unlocking the doors became increasingly more difficult until that too became impossible. Soon the plaintiff was unable to unlock her front doors by any method (i.e. using the FOB or manually) which meant that her vehicle could no longer be locked (either when driving or when it was parked and left alone).

At this point her Kia Optima posed an unreasonable safety hazard.   A vehicle door lock that will not unlock on demand poses a clear and definitive safety risk to vehicle occupants who may need to egress the vehicle quickly in the event of a crash, vehicle fire, or other emergent circumstance.   But defective Kia optima door locks failed to assure that this could happen, as their defective nature meant that, as in Plaintiff’s case, the door could not actually be unlocked and opened on demand.

The defect also led to a corollary safety risk.  On the one hand, Plaintiff could not lock her doors without running the risk of being trapped inside in the event of an accident or if she could not contort herself in order to climb over the seats and exit the rear of the vehicle. On the other hand, forcing Plaintiff to drive the vehicle without  locking the doors in order to account for the defective door locks that could trap her in the car poses its own independent safety concern.

For decades, U.S. Department of Transportation Federal Motor Vehicle Safety Standards (“FMVSS”) have mandated that all cars on U.S. roadways be equipped with working vehicle locks.  See FMVSS 206.   As the National Highway and Safety Administration (“NHTSA”) has made clear, the purpose in mandating operational door locks in U.S.-driven vehicles is “to minimize the likelihood of occupants being thrown from a vehicle as a result of impact.” NHTSA Test Procedure for FMVSS No. 206 “Door Locks and Door Retention Components” (Feb. 19, 2010), at 2.  It is quite apparent, then that a vehicle door lock that is not locked by the driver or vehicle occupants for fear that doing so will prevent these occupants from unlocking the doors, therefore, fails to provide the door lock protection mandated and called for by FMVSS 206, thereby posing a serious safety concern of its own.

Plaintiff is not alone.  As demonstrated below, the internet shows hundreds of Kia owners complaining about the same problem.  Indeed, approximately 34% of the complaints lodged by Kia Optima owners of Class Vehicles on the National Highway Traffic Safety Administration (“NHTSA”) website were for this very Door Latch Defect.

Despite notice and knowledge of this defect from the numerous consumer complaints it has received, information received from dealers, NHTSA complaints, and its own internal records, Kia has not recalled the Class Vehicles to repair the defect, offered its customers a suitable repair or replacement free of charge, or offered to reimburse its customers who have incurred out of pocket expenses to repair the defect.  Upon information and belief, Defendant knew at the time of the original sale of Plaintiff’s vehicle of the existence of the Door Lock Defect but failed to disclose this defect to Plaintiff or to consumers of the Class Vehicles at large.

As a result of Defendant’s unfair, deceptive and/or fraudulent business practices, owners and/or lessees of Class Vehicles, including Plaintiff, have suffered an ascertainable loss of money and/or property and/or loss in value. The unfair and deceptive trade practices committed by Defendants were conducted in a manner giving rise to substantial aggravating circumstances.

Had Plaintiff and other Class members known about the Door Lock Defect at the time of purchase, they would not have bought the Class Vehicles, or would have paid substantially less for them.

As a result of the Door Lock Defect and the considerable monetary costs associated with attempting to repair such defect, Plaintiffs and Class members have suffered injury in fact, incurred damages and have otherwise been harmed by Kia’s conduct.

I have a Kia sorrento 2013 purchased new in stamford connecticut. Door handle back passenger side where my granddaughters car seat is fell off in my hand. I had to climb in back seat and pull her out in an awkward and difficult position since I recently had a double mastectomy and am still week from the chemo. They ordered a new part and said they repaired it. Door handle is back on but I went to put her in the carseat at daycare and the door wouldn't open. I'm livid. It was 85 degrees and I had a toddler that it had to maneuver thru the other side to get her in. I hate to play the cancer card here but this has been difficult. I'll call again and I hope this time they fix it but I am definitely worried about the other doors now. Don't even feel comfortable driving the car

I have a 2004 Kia Optima. My driver door has done the same thing. It started a couple weeks ago. This is extremely dangerous! I am having to climb in and out of my passenger side. I had a herniated disc and had surgery in March. I was doing fine. Since having to climb across car to get in and out, I now have a re herniated disc and require surgery again.

Different door locks are acting up at different times with my 2010 Kia Optima. Drivers door seems to be the worst. Doesn't matter if it is with the key Fob, key, or power lock control on the armrest. The locks are also acting up on occasion witht the automatic lock and unlock function. Seems the more frequesntly I attempt to unlock or lock the doors the more they fail. For no reson they will begin working for a few clicks and then start failing again.

I have a 2005 Kia Sorento and when I unlock the doors they automatically re-lock by themselves on both the driver's side and passenger's side. This happens at least half of the time. It is intermittent. Sometimes they re-lock only once by themselves and other times they re-lock 3 or more times by themselves. It happens almost instantaneously and I am worried I might get locked out of the car even if I have the key in my hand. Help.

Same issue with my 2011 Sorento LX driver front door not opening from the outside. Upon taking to the dealer for diagnostics and repair, OF COURSE they informed me it wasn't covered by my extended warranty (even though this is apparently a common issue) & total repair costs would be in excess of $500.00. I declined the repairs, while still having to pay the obnoxious $99 obligatory diagnostic fee (BS!) I will purchase the part and have repaired by a private mechanic and then get rid of it! Hate to say but after having THREE kia vehicles, I'm throwing in the towel, their service, customer experience and part quality are HORRIBLE!

Just had my first experience with this with my 2011 Kia Sorento... Went to go to the store and the soor worked fine... Came out of store and couldn't open my drivers side door from the outside. And of course isn't covered under warranty because it is considered a "normal wear and tear" item.... PLEASE I've had the car for less than a year!!! Told me it would be almost $300 to fix it... Needless to say I'm finding the part cheaper online and having it fixed somewhere else. Hopefully this isn't the beginning of a reoccurring nightmare..... So upsetting.

We don't have a key fob that unlocks/locks the door, just a key but everytime my daughter would unlock the door with the key and pull the handle it would lock back up. Of course I call the Kia dealer this morning and they don't acknowledge this problem, even when I mention the fact that there is a class action suit for this issue. Both front doors will not open, you can't remove the trim to get at the issue because the door is not open. Ridiculous to make the door need to be open to fix issues when most are because the door will not open. 2011 Kia Sorento - having the same issue. 2 weeks ago the rear, driver side door would not open from the outside. Today, the same thing happened with the front, driver side door. I called Kia and was told that this is not a safety issue therefore it does not warrant a recall. I was told to take to Kia dealer and have them diagnose the problem. I will do this, but after a lot of research I have found that I am not alone in this problem. There are over 500 claims on the same problem, same year, make and model on the National Highway and Safety Admknistration and here are many others on different websites. I feel this is something to look into and start a class action suite if Kia is not going to do anything about it.

Potentially a safety issue with not being able to open the door from the outside in an emergency. Fix is expensive and Kia won't cover it. I noticed the fuse to the door locks was missing so i replaced the fuse and i locked the doors, and every door locked and unlocks except for the driver side door. On 6-2-2016, my 2006 Kia Optima front drivers outside and inside door handles would not open manually or by electric button. The front drivers door was stuck.
I had to crawl out through the passenger front side door.
On 6-3-20016, the Arizona Phoenix Kia dealership had to replace the front drivers latch door assembly and front drivers lock actuator. It cost $446.65 for the parts and labor for a duration of 2 1/2 hrs labor time.

I have four children and I have to climb over the passenger seat to get out of the car. I have contacted Kia about the issue just to be told there has been no recall on it. I have been sitting in my vehicle sometimes and the Door locks start going crazy locking and unlocking by themselves. This is truly frustrating, inconvenient and I would hate to think if something were to happen and I couldn't exit my vehicle to get my kids out. Having the same issue with my 2011 Kia Optima. First it was just my driver side door not locking with the key fob. So I had to manually lock it so that it would lock the car. Then it was my passenger side back door. Since I don't have many people that ride with me it wasn't a major issue, but now the passenger side door will not lock. I just paid this car off and I'm pissed if this is how this is going to be seeing that I wasn't planning on purchasing another vehicle for awhile. Have the same issue with my 2005 Optima. Locks would go crazy and lock themselves while I was driving and I couldn't be able to get out if the drivers side door. Husband took out fuse for automatic locks and solved the random locking issue but if I accidentally lock my driver's door I won't be able to open it for awhile. Randomly, weeks later it will just open. Crazy that there is not a recall on this. It's very unsafe!!!

I have a 2006 Kia Spectra. Only use a key for entry and electronic locks fail more than half the time when pushed. Within one month I had front passenger door and left rear door handle both come off in my hands when trying to open due to lock failing to work. What a waste and unsafe way to drive.We can only exit from the drivers spot or the right rear side of vehicle.

My driver's side door will not unlock or open period. It started last night. I have an infant and a seven year old. I can't just not drive but this is dangerous. I had always had intermittent problems with automatic locking and unlocking but it always seemed to resolve itself on its own so was not such a problem. However, about 1 year ago 1/2015), the driver side door stopped responding to the key fob but you could lock it manually (inside) and unlock it with the key (from the outside). Now (8/2016), the same drivers side door will not lock at all and I can not secure the car properly.

Same issue with a 2011 Kia Soul Sport. After rain or snow, Driver's side door sounds like it unlocks, but, the door will only open after repeated pulls on the outside door handle or banging on the door panel which now has a nice dent in it under the handle. I have already pulled the handle halfway off the car because of this issue. This problem is intermittent. Car is from a dealership used, but with no warranty.

My wife and I just bought a 2011 Kia Sorento. That day, as my wife went to enter through the front passenger door, the door handle broke off. Informed Dealer who advised they would get that fixed for us. Then, not even a week later, the driver's door handle will not open from the outside. I have to either open the back door and reach very far forward to open it from the inside (which the door doesn't always stay open), or I have to stick my finger in the passenger door's hole where the handle used to be in order to get in the passenger door and climb over to open the driver's door. Very disappointed with Kia regarding this. It seems like it would be a simple fix, yet they refuse to recall it.

Same issue with my 2011 Sorento LX. Currently only effecting the drivers door, where the front door cannot be opened from the outside. Right now, it's an extreme inconvenience and an embarrassment to be driving a "klunker" that I paid good money for. As this issue progresses, as I read it will, it will also be a safety issue as someone, including the grand kids could be locked inside the car. Kia also should be embarrassed.

As others have stated, this is a safety issue that kia should be forced to address. If defective locks were common knowledge, we would not have purchased the vehicle.

I posted a response a week or two ago. Since then I went into our little town with on street parking. When I completed my errand I needed to get back into my 2011 Sorento with the drivers door that won't open from the outside. There I was with the back door wide open and my legs hanging out as trafic wizrd by me as I struggled to get the front door opened from the inside. In that position, you can't see if there thete is traffic coming, how fast its going, if its a wide load, how close it is to you, and if it is under control. You don't know what's coming and you have no way to get out of harms wsy if you wanted to. Scarry, and very dagerous!

My 74 year old mom's kia optima is having this problem. SHE WAS LOCKED INSIDE THE CAR AFTER THE LOCKING MECHANISM FAILED. she had to climb out the passenger side. It took her over an hour to get out of the dam car! My family and friends will never buy another Kia if I have anything to say about it. Kia should fix this problem before someone dies. I was not informed of this problem when I purchased the vehicle and after researching this problem I find that this problem has existed for a long period of time and Kia has not done anything to remedy the problem or reimburse the owners for repair.

I've been given the run around multiple times because they don't see it as a safety issue. Oh but if my car catches fire or is submerged in water and God forbid my kid is in the car, the electronic windows will probably be inoperable in water or fire and I guess we are just stuck in the car since you can't get it open from the inside or outside with key, with fob, manually.... today I literally cried in my car for about 25 minutes in my driveway because I am so tired of climbing in an out the window. I live in michigan, and it's 18 degrees outside and I can't do a lot about warming up my car cause I gotta leave a window down to get in and out, and who knows how long it will be before my radio gets stolen or maybe even the whole car...

I own a 2006 Kia Optima that is having the same issue as other owners. My Driver side door is stuck shut. I can't open it it from the outside or inside by any means. I had back surgery last year and I am just now able to return to work. Climbing over seats to get in my car is not comfortable at all. Does anyone know how much this problem costs to fix? I have a 2014 Kia Sorento. It started only with the driver door not locking with the key fob. Then all doors would not lock with the key fob. Now I can't even lock the doors with the door control panel. I have to manually go around the car and lock all doors. If I am driving I can not lock the doors. It is scary to know I am driving with unlocked doors. The dealer informed me that I would have to pay $140 to check it, but that does not include the repair. That is just insane!
