This is a consumer class action on behalf of all persons who purchased organic-based or matted shingles manufactured and/or distributed under various trade names by IKO Manufacturing Inc., IKO Industries Inc., IKO Industries Ltd., or IKO Midwest Inc., and IKO Production, Inc. (collectively “IKO” or “Defendant(s)”).

Defendants manufactured and marketed its Shingles under various brands and product names including but not limited to: Château, Renaissance, Renaissance XL, Aristocrat, Total, Armour Seal, Superplus, Armour Lock, Royal Victorian, New Englander, Imperial Seal 20, Cathedral XL, Ultralock 25, Armour Plus 20, Armourtite, Cambridge Ultra Shadow, Crowne 30, Vista, Supreme 20, Fastlock 25, Leading Edge, Nordic, Quantum 35, Seville 25, Superlock, Superseal, and Skyline for sale nationwide.

According to the complaint, all IKO Shingles are manufactured using the same basic formula: a base layer of organic felt saturated with asphalt, a middle layer of an oxidized asphalt coating, and a top layer of mineral granules with a strip of asphalt sealant.

IKO markets and warrants all the Shingles as durable, and as offering long-lasting protection for a specified life ranging from 20 to 50 years, or in some cases, for a lifetime. The industry and consumers recognize the warranty nomenclature as having the following meaning: a shingle with a 25-year warranty is referred to as a “25-year shingle.”

IKO’s sales brochures, marketing literature, and packaging furthermore claim that IKO Shingles meet very specific industry specifications and standards for sampling, testing and analysis. In particular, IKO represented to consumers that their shingles met ASTM D225-07 specifications for organic felt asphalt shingles and that IKO Shingles adhered to ASTM D228 testing procedures for sampling, examination, physical testing, and analyses.

As alleged, IKO did not adhere to ASTM D225-07 specifications and failed to comply with the advertised testing procedures. The Shingles manufactured and sold by IKO are defectively designed and manufactured such that they fail prematurely causing damage to the underlying structures.

The defects present in IKO Shingles are so severe that Plaintiff and members of the Class must repair or replace their roofs sooner than reasonably expected by ordinary consumers who purchase shingles generally and by consumers who purchased these Shingles specifically.

 

CLASS:  All individuals and entities that have owned, own, or acquired homes, residences, buildings or other structures physically located in the United States, on which organic IKO shingles are or have been installed since 1979. “Organic IKO shingles” is defined as all organic shingles manufactured or distributed by Defendants.

We purchased our home April 2013 and I started noticing months later that the shingles were turning upward. I did a warranty repair submission with the builder. I service person came by and told us that the glue was not adhering, that there were lose shingles, and if it was his roof he would have it replaced. He reported to the builder and about a month later, we received and email from the builder indicating that there is nothing wrong with our roof and there was a letter attached from IKO stating that we needed to allow our roof to be exposed to a summer heat. We purchased April 2013, made the complaint late 2013 and received the letter feb 2014. I advised them that we have been through a summer heat and we were told you have a warranty and the option to have anb independent roofer to inspect the roof at our expense. I feel like we are being railroaded. We have IKO Marathon 25 year AR shingles.

My house was built in 2001 and the IKO shingle roof is falling apart. Shingles are curled and crumbling after 13 years. I have been told by several roofing experts that this is a defective shingle and basically a catastrophic failure of the shingle. 2002 IKO aristocrat shingles. did not seal the 1st year. IKO paid someone $1200 to glue them down. this didn;t work shingles degranulated ( many totally degranulated ) curled and we replaced this year. Went through IKO warranty process. Have and Offer for $450 for 63 bundles of shingles if we release them from warranty. Wow.

I have the same issue. Shingles were installed 12 years ago and they look like they are 40 yrs old. Granules all coming off and felt exposing, curling as well. I have the paperwork for waranty but that is all prorated and doesnt cover labor installation. I have allready replace some parts of the roof where they were leaking.

I just lost the sale of our home because the inspector noticed our roofs (3) are shingled with IKO Chateau organic architectural shingles. I am scrambling all over the place trying to find out where the house shingles were bought, we are lucky we do know where the shingles for the barn and farmers porch came from as we built those after we bought the house. I am horrified at the condition of the shingles that were installed in 2002. Everyone I talk to tell me we are basically screwed. Have read that the judge in the United States refused to certify the class action suit while the judge in Canada did certify the Canadian class actin suit. I wish someone could tell me what I should do.

Have Chateau 35. Was put on in 2003. Now the whole roof facing south need to be replaced as granules keep coming off (for several years now)and has disintegrated. The north, east and west sides have curling and fish-mouthing. All told- we have a quote of $17,000 to do the whole roof that was suppose to last 30-35 years

The south side of my roof is curling and peeling, the rest does not look as bad but has started doing the same, I called a contractor to find out why, He told me they were IKO shingles and I would have to go to the store where they were purchased to get a complaint form. I called the company rep. she told me that they would pay for the shingles (at todays' cost) and then prorate any use I have received. the shingles are about 12 years old. Currently I can only afford to repair the part that is leaking, My deck is always covered in granules ans pieces of the roofing. Very frustrating.

I have IKO Cambridge Ultra Shadow fibre glass shingles installed in 1997, supposedly with a 25 year warranty. My ridge vents are shot, rotted, and the shingles on the drip line are worn. I'm having trouble determining if these shingles are subject to a class action lawsuit. I don't know where they were purchased but I do still know the installer is in business. Any suggestions how to proceed with a complaint?

My IKO shingles were installed in 2006. I bought 30 year shingles. When replacing skylights this summer, we found many dried out and curling shingles. The dealer who sold us the shingles sent one to IKO. So far we have heard nothing. There are many leaks inside the house and need help to recover some costs to replace shingles and repair water damage.
IKO should take more responsibility for defective products.

My roof is 17 years old and it was done with iko Cambridge ultra shadow shingles...they are curling , granulating every time it rains, worn at drip lines, installer out of business..they are "warranty is 30" years...what should I do?! In addition my old shingles had no mold,fungus, when I replaced those 30 yr.
,shingles...the new one now has it growing after 17 years. Should I try to clean that stuff off with 50/50 water and bleach, spraying it on and allowing future rains clean it off, I do not dare to brush or power wash shingles...

Same as Sherry C above. House finished in 2003. Shingles first started loosing top "gravel" layer year after discovering a lot of the "gravel" on the patio. This year the shingle is crumbling and that is now on the ground. My construction man who bought the IKO Imperial Gentry 25 shingles for the house and garage is now telling me that he will need to replace the entire roof. I am over 77 years old & can't afford the new roof. What is my options. I still have the shingles that are coming off the roof and the original covering that the bundles were in when bought. Also have the invoice.

Looks like I am adding my experience with everybody with IKO roofing. We built our house in 1998 and used the Royal Victorian shingle with a 25 year warranty. Here it is 16 years later and my shingles are crumbling. Now I received a notice from my insurance company that I need to replace or repair or my insurance will be terminated. I am getting quotes but I don't think I should be paying when it was expected to get close to 25 years out of the roof.

We built a house in 2010 used IKO shingles. Piece of crap! Shingles did not seal down. Whenever wind blows my shingles are in the air. Noticed it over a year ago but its getting worse quickly. I recently heard about this class action suit and followed up on it and I am amazed that such a big company would do this to all of these nice folks. Have had various leaks over the years ( I attributed them to freak rain or wind speeds). Had some storm damage May 11th, 2015. Had a contractor give an estimate for repairs which amounted to $9616.50. Called insurance agent and when claims adjuster looked at the roof they said they would not cover it due to "faulty organic shingles". I bought 75 bundles of my IKO 25-year Aristocrat shingles in May of 2001. My roof has issues with curling, crumbling, and tremendous granular loss. I started looking into contacting the manufacturer for compensation when I discovered this class action suit. I'm not looking forward to replacing a roof that I assumed would last at least another 10 years. IKO should compensate us for this and whatever repairs are needed.

I have Renaissance XL shingles that were installed on a manufactured (Guildcrest) home in 2000. The shingles are blistered, cracked, crumbling, and the granules have mostly been washed away. My home is in the New Paltz area of NY. I'll need to replace my roofs (I own 2 houses that were installed at the approximately same time - my own and my parents) this year, before I have significant leaks. Shingles were installed professionally, inside the facility in 2000. My current contractor says the shingles look like they've been on for 35 years, but they are less than 15 years old. I have claims in to IKO as of June, 2015, but haven't heard anything from them, yet. Based on the warranty, I doubt they'll pay much. Please advise on progress of the class action suit. Thanks.

Update - received a response from IKO on August 6, 2015. They are willing to pay a "Goodwill Release of Warranty" amount of approximately $1200.00 for both houses. The total number of squares is 77. I do not plan on accepting this offer.

On June 16, 2004 I had 32 square of IKO Weatherwood Chateau shingles professionally applied to a completely stripped bare to sheathing, applied over a layer of ice and water shield and 30 lb felt paper. Since 2012 I've had continual problems during winter months in Upstate NY. Leaking from saturated, curled, torn, delamination and excessive loss of granular exterior surface. I was told that we are out of luck because the warranty only holds to the previous owner and isn't transferrable. I installed Chateau shingles in 2001. At the time of purchase I was told they were lifetime warranty. I discovered they were deteriorating In July of 2015.
I followed IKO's warranty requirements and they offered to pay me 23 percent of the cost of my new shingles. Nothing for labor, other materials, or damage done to the structure. This warranty amounts to predatory false advertising. They lead you to believe that their product will last a lifetime, and when they fail, you find out that your warranty only entitles you to pennies on the dollar in comparison to your total cost.

Yes, I am having the same problem . IKo shingles installed on roof spring 2004.3 years ago I started having leaks into my house...... shingles bare, gravel gone. Contractor no longer returns my telephone call. (It was the contractor who advised me of the problem with the IKO shingles.... as he installed them on his house and on a private school. He is part of the class action suit,but never made good to me nor suggested that I become part of the suit. I have now had to hire a different contractor to make temporary repairs, but unfortunately at some point I will need to have a re-roofing job done.

Just filed my 3rd claim with IKO. New house built in 2002 - 2003 in NH. Used IKO Renaissance XL. Last week my Solar installation came to a halt as the contractor feared walking on and installing the Solar Array would accelerate an already deteriorating situation.

Less than 3 years ago i was denied any satisfaction from IKO after going through the whole warranty claim practice.

To me, IKO is like dealing with health insurance companies that deny claims until you demonstrate you will not take no for an answer. The lady from IKO warranty did not appreciate this comparison.

The roofer bought them, and didn't keep the invoice! But I have two bundles of extra shingles, with the lot number. I purchased my home back in 2010. It was a brand new home that was built in late 2009. I did not build this home but found it through a real estate agent. Back in Feb 2016, we had 2 storms with high winds. I lost shingles and had a roofing company come out and replace them and also do an inspection of the entire roof. By February 2016 every time the wind blows they are all standing straight up in the air flapping on the roof. The neighborhood comes out to watch it. After a terrible hailstorm that devastated the local area, we had to have our roof replaced. Our roofing contractor used organic IKO shingles- dual brown (I don't remember the style). We developed a slight leak and thought it must be a ridge vent or sewer pipe issue because the roof is only 10 yrs old. We had an insurance assessor come out and inspect everything. He said the organic roof tiles were worn out and allowing water to saturate them in spots. Once we heard this, we asked others, in and near our neighborhood, that had their roofs replaced at the same time with the similar shingles. We found out that a lot developed leaks.

My husband is a Roofer and he has used IKOs for many many any jobs and I was informed by the supply company the the IKOs were the top of the line shingle and excellent at making it right if there ever were to be a problem.....YAH RIGHT THAT IS A LIE. We have been trying to get ahold of IKO for numerous roofs and have yet to be contacted. So we go to the supply house (ABC roofing/siding in muskegon Michigan) and they say they have nothing to do with it and that we need to contact IKO, which we have plenty of times. Our Roof,(becuase i installed them on my own home, to test and make sure it was standing up to its expecations) and the test totally failed. Not only are they cracking, granules are everywhere, and in one area (approx. 4 bundles worth) there is a section of the roof where the shingles are a totally different green then the rest of our roof. Ive contaceted a lawyer and will take action. what type of company offers a lifetime (25-50 +)warranty and it dont even hold up to a quarter of what its suppose to (put roof on in 2011 2 1/2 years later started noticing dis-coloration of certain shingles, granules everywhere, and leaking going on). And we are yet to have someone contact us.

Last December I sold the home and had to reduce the price by $12,365, du to the defective condition of the roof shingles.

Just found out I have IKO defective shingles. The roof has been "melting", can't distinguish individual shingles but looks like red tarpaper now instead of shingles (it is a red roof). Every time it rains lots of granules in gutters and on ground, shingles curing up at edges. Installed 2008, only 8 years of wear!!

Thinking about having solar panels installed on my house, built 2003. Solar contractor said my shingles are so brittle, they would not install panels on my roof. I would need to replace my roof first. I have two bundles of shingles in my basement still with plastic wrap stating name on them - IKO, Aristocrat 25. I had expected to get 25 years out of them, and spent extra early on to insure quality and years before having to replace. I'm angry!!
My niece built a year after me, same problem, same builder, same supplier, although I don't know her brand, suspect IKO, too.

We are in the early stages of purchasing a home in Gilford, NH with Aristocrat shingles that erected installed in 2003. They are curled, shrinking and SOP brittle. Has there been any action taken gains tax IKO yet or are there recalls? This is the first site that I have visited so far.

I moved into my house in 2010 with almost 5 year old Renaissance XL roof. The shingles have been degranulating for years (blocking my eaves with granular bits). Then last year they suddenly starting curling - drastically. Got the roof replaced now - roofer told me they helped another client get money back (prorated amount based on balance of warranty). Asked me to go online and get form from IKO website. Didn't find it and called IKO. They gave me a bunch of weasel clauses why I don't qualify for any refund (the internet said there should be a "goodwill claim form") - check out http://www.ikoshingleslawsuit.com/
Apparently, as I did not get the warranty transferred to me by the previous owner and did not claim within 2 years of moving in, I don't qualify!!

Just found out yesterday that our IKO 25-year roofing shingles installed by a reputable contractor in 2013 has completely deteriorated to the point of needing replacement right away. This is ridiculous and impossible for two retirees to cover the costs. Thought we were good by doing all of these replacement items before our retirement. What does a homeowner do when they cannot afford to redo what they had already taken care of before retirement!

I built an addition on my house in 2002. I removed all existing shingles on the original house, and did a complete re-roof of the entire structure, using IKO Royal Victorian 30 year shingles. Two years ago, they began to curl, and now they are lifting up, are extremely brittle and starting to blow off. Even in areas where the shingles are still semi-intact, my roof is starting to leak. I am an experienced roofer, and I have seen shingles 5-10 years past their stated warranty in better shape than mine. They are clearly an inferior product.

I installed IKO shingles and have had two claims in less than four years. They had plenty of time to adhere in a summers heat. The wind literally blows the shingles off in patches, the shingles are now a discontinued product.

I bought a brand new double wide from champion homes in 2014 .in 2015 I noticed that some of my roofing was raised up so I hired a contractor to come and put them back down . a few months ago we had some winds and it blew a big patch of roofing completely off I noticed that the seal looked like it had never sealed. so I contacted champion who in turn told me to get ahold of I K O so I did , they told me to fill out there claim pkt and to take pictures of all ventilation ,roof ect and to send in a few pieces of the roofing that had come off. I specifically ask how to send it they told me to put it in one of those "if it fits it ships" boxes from the post office so I got the biggest that they had and knew right away that it was not going to fit ,so they told me to break them up and put them in the box ,so I did leaving the pieces as big as possible . u could still clearly see the seal that hadn't sealed . I waited around 3 weeks and finally I called them back . the ladie tells me that I didn't send in enough roofing so therefore there findings were no fault of theirs and that I could send in more if I wanted to and they would review it. I had already spent 20 dollars sending them the other box that had more than they had ask for in it. so I called back a few days later and the ladie says well ! the roofing u sent was broken up into too many pieces and we couldn't make a decision on that. I immediately knew then that it was just going to be one excuse after another and I was just going to be spending 20 dollars a wack every time to send them roofing for them to tell me no! so I turned it into my ins company, when the adjuster came to look at the roof he too said that it was because the roofing had not sealed properly.I am very frustrated , I am a widow and by myself , I bought the home after my husband had passed thinking that I wouldn't have to worry about anything for at least a little while by it being brand new, but here I am ,probably gonna have to put a new roof on and it is. only 21/2 years old. I built a new garage in 2002 with 25 year Aristocrat shingles. The roof shingles are now disintegrating at a rapid rate. It looks like a cancer spreading across the roof. I completed a claim with the company, and was sent a "Goodwill Release of Warranty" document. Upon signing and submitting this document, the company will pay me the sum of $157.20 due to the pro-rating of the warranty. They assert no responsibility for the labor costs of tear off of the old roof, clean up, and installing a new roof.

We rejected a $1,300 offer to settle for a new roof that cost us $31,000. We are now suing in small claims court (NH) for $10,000 and received a default judgement when they (IKO) did not respond to the court's first class mail with our complaint. In 2008 my roof was re-shingled with IKO Cambridge shingles after a complete tear-off and additional attic venting installed. We have IKO Chateau shingles in Harvard Slate that were installed in late 2004 and now are so failed we need a whole new roof, 13 years into a "35-year shingle". Had IKO Chateau shingles installed in 2001 and they began to fail several years ago but I naively believed that was the "architectural" design. I am now preparing to sell my home and inspector states "the shingles are junk and completely deteriorated, curling and pieces breaking away." Roof fails inspection so I'm left with paying for a new roof, after only 14 years into a "40 year architectural shingle".

Built a new home in 2014 and upgraded to 35 year architectural (Chateau) shingles from IKO thinking that we wouldn't need to worry about a roof for at least 25 years. Boy were we wrong; at 13 years, our shingles are literally crumbling, curling or falling apart altogether. Just got our first estimate after IKO offered us a $540 settlement if we signed their release. New roof estimate is between $12,500 and $13,500....not sure where we are supposed to come up with that kind of money, but the roofer says that if we don't replace before this coming winter, we might have even bigger problems.

We had an addition in 2004 with IKO shingles. The shingles are now crumbling and curling. After completing all the paperwork, pictures of roof etc, IKO offered us a whopping $147.00, approximately 30 percent of the cost of the shingles with no labor. Roughly 2 percent of the cost to replace our shingles and reroof the 13 year old roof
